The Office of Educational Quality and Accountability is\n\nhereby authorized to conduct a performance review program to\n\ndetermine the effectiveness and efficiency of the budget and\n\noperations of school districts that have:\n\n1. Administrative service costs which are above the expenditure\n\nlimits established for school districts in Section 18-124 of this\n\ntitle or have total expenditures in excess of the district's adopted\n\nbudget;\n\n2. A district academic performance data score, calculated\n\npursuant to the Elementary and Secondary Education Act of 1965, as\n\namended or reauthorized, that is below the state average academic\n\nperformance data;\n\n3. Had a request for a performance review submitted by the\n\nGovernor or the State Superintendent of Public Instruction;\n\n4. A district student eligibility rate for free or reduced-\n\nprice meals under the National School Lunch Act that is above the\n\nstate average; or\n\n5. Submitted a request for a performance review subsequent to a\n\nmajority vote of the district's board of education.\n\nB. Funds appropriated by the Legislature to the Office of\n\nEducational Quality and Accountability may be expended to fulfill\n\nthe provisions of this section. The Office of Educational Quality\n\nand Accountability may contract with an outside entity or hire\n\npersonnel to assist in the development and design of the program.\n\nThe Office of Educational Quality and Accountability may contract\n\nwith outside entities to assist in conducting performance review\n\nprograms. Such entities shall be chosen through a competitive bid\n\nprocess. Invitations to bid for the performance reviews shall be\n\nopen to any public or private entity. Contracts for performance\n\nreviews shall not be done on a sole source basis.\n\nC. 1. If a performance review is conducted as authorized\n\npursuant to paragraphs 1 through 4 of subsection A of this section,\n\nthe entire cost of the review shall be borne by the Office of\n\nEducational Quality and Accountability.\n\n2. If a school district requests a performance review, as\n\nauthorized pursuant to paragraph 5 of subsection A of this section,\n\ntwenty-five percent (25%) of the entire cost of the review shall be\n\nborne by the school district and seventy-five percent (75%) of the\n\ncost of the review shall be borne by the Office of Educational\n\nQuality and Accountability.\n\n3. Districts shall be selected for review by the Commission for\n\nEducational Quality and Accountability contingent upon the\n\navailability of funding.\n\nD. The Office of Educational Quality and Accountability shall\n\nengage in follow-up, outreach and technical assistance to help\n\nschool districts and others understand, interpret, and apply the\n\nrecommendations and best practices resulting from performance\n\nreviews conducted pursuant to this section.\n\nE. After a performance review of a school district is completed\n\nby the Office of Educational Quality and Accountability, the school\n\ndistrict may implement all or part of the recommendations contained\n\nin the review.\n\nF. If a school district experiences a cost savings that is\n\ndirectly attributable to implementation of performance review\n\nrecommendations, the cost savings shall be expended by the school\n\ndistrict for classroom expenses.
