Upon approval of an empowerment plan for a school, zone, or\n\ndistrict, the State Board of Education shall waive any statutes or\n\nrules specified in the approved empowerment plan as they pertain to\n\nthe empowered school, zone, or district; except that the State Board\n\nshall not waive requirements for the following:\n\n1. School district employee participation in the Teachers’\n\nRetirement System of Oklahoma;\n\n2. The Oklahoma School Testing Program Act;\n\n3. The requirement for students enrolled in the school district\n\nto demonstrate mastery of the state academic content standards as\n\nset forth in Section 1210.523 of Title 70 of the Oklahoma Statutes;\n\n4. The accountability system as set forth in Section 1210.541\n\nof Title 70 of the Oklahoma Statutes; and\n\n5. The federal “No Child Left Behind Act of 2001”, 20 U.S.C.,\n\nSection 6301 et seq.\n\nB. Except as otherwise provided in this subsection, the State\n\nBoard of Education shall not waive any statute or rules specified in\n\nthe approved empowerment plan for an empowered school, zone or\n\ndistrict if the statute or rule relates to the implementation of or\n\nrequirements for any program or grant for which the school district\n\nis receiving funds appropriated for the support of public school\n\nactivities. The State Board of Education may waive any statute or\n\nrule that relates to the implementation of or requirements for any\n\nprogram or grant only if the funding for the program or grant is no\n\nlonger allocated to the school district.\n\nC. Designation as an empowered school, zone, or district shall\n\nnot affect the allocation of State Aid funding for the school\n\ndistrict as calculated pursuant to Section 18-200.1 of Title 70 of\n\nthe Oklahoma Statutes.\n\nD. 1. If the school district board of education for an\n\nempowered school, zone, or district revises an empowerment plan as\n\nprovided in Section 9 of this act, the school district board of\n\neducation may request, and the State Board shall grant, additional\n\nwaivers or changes to existing waivers as necessary to accommodate\n\nthe revisions to the empowerment plan unless the State Board\n\nconcludes that the waivers or changes to existing waivers would:\n\na. be likely to result in a decrease in academic\n\nachievement in the empowered school, zone, or\n\ndistrict, or\n\nb. not be fiscally feasible.\n\nIn requesting a new waiver or a change to an existing waiver,\n\nthe school district board of education shall demonstrate the consent\n\nof a majority of the teachers and a majority of the administrators\n\nemployed at each school that is affected by the new or changed\n\nwaiver.\n\n2.
