On and after the date on which the State Board of\n\nEducation approves a school, zone, or district as an empowered\n\nschool, zone, or district, any collective bargaining agreement of\n\nthe empowered school, zone, or district shall include a provision\n\nthat allows each empowered school, zone, or district to waive any\n\nprovisions of the collective bargaining agreement identified in the\n\nempowerment plan as needing to be waived for the empowered school,\n\nzone, or district to implement its identified innovations.\n\n2. For an empowered school, waiver of one or more of the\n\nprovisions of the collective bargaining agreement shall be based on\n\nobtaining the approval, by means of a secret ballot vote, of at\n\nleast sixty percent (60%) of the members of the collective\n\nbargaining unit who are employed at the empowered school.\n\n3. For an empowered school zone or district, waiver of one or\n\nmore of the provisions of the collective bargaining agreement shall\n\nbe based on obtaining, at each school included in the empowered\n\nschool zone or district, the approval, by means of a secret ballot\n\nvote, of at least sixty percent (60%) of the members of the\n\ncollective bargaining unit who are employed in the zone or district.\n\nThe school district board of education for the empowered zone or\n\ndistrict may choose to revise the plan for creating an empowered\n\nzone or district to remove from the zone or district any school in\n\nwhich at least sixty percent (60%) of the members of the collective\n\nbargaining unit employed at the school do not vote to waive the\n\nidentified provisions of the collective bargaining agreement.\n\n4. If a school district board of education, in collaboration\n\nwith the empowered school, zone, or district, revises the\n\nempowerment plan, as provided in Section 9 of this act, and the\n\nrevisions include changes to the identified provisions of the\n\ncollective bargaining agreement that need to be waived to implement\n\nthe innovations that are included in the empowerment plan, the\n\nschool district board of education shall seek such additional\n\nwaivers or revision or revocation of the existing waivers of\n\nprovisions of the collective bargaining agreement as are necessary\n\nto implement the revised empowerment plan. Any changes to waivers,\n\nor additional waivers, of the identified provisions of the\n\ncollective bargaining agreement shall be subject to approval in the\n\nsame manner as provided in paragraphs 2 and 3 of this subsection for\n\nthe initial approval of waivers of provisions of the collective\n\nbargaining agreement.\n\n5. Except as otherwise provided in paragraph 4 of this\n\nsubsection, waiver of identified provisions of a collective\n\nbargaining agreement for an empowered school, zone, or district\n\npursuant to this subsection shall continue as long as the school,\n\nzone, or district remains an empowered school, zone, or district. A\n\nwaiver approved pursuant to this subsection shall continue to apply\n\nto any substantially similar provision that is included in a new or\n\nrenewed collective bargaining agreement for the schools of the\n\nempowered school, zone, or district.\n\nB. A person who is a member of the collective bargaining unit\n\nand is employed at an empowered school or zone may request a\n\ntransfer to another public school in the district.
