The Oklahoma Charter Schools Act shall apply only to charter\n\nschools formed and operated under the provisions of the act.\n\nCharter schools shall be sponsored only as follows:\n\n1. By any school district located in this state, provided such\n\ncharter school shall only be located within the geographical\n\nboundaries of the sponsoring district and subject to the\n\nrestrictions of Section 3-145.6 of this title;\n\n2. By an accredited comprehensive, regional, or two-year\n\ninstitution that is a member of The Oklahoma State System of Higher\n\nEducation or by a private institution of higher learning located\n\nwithin this state that is accredited pursuant to Section 4103 of\n\nthis title;\n\n3. By a federally recognized Indian tribe, operating a high\n\nschool under the authority of the Bureau of Indian Affairs as of\n\nNovember 1, 2010, if the charter school is for the purpose of\n\ndemonstrating native language immersion instruction, and is located\n\nwithin its former reservation or treaty area boundaries. For\n\npurposes of this paragraph, native language immersion instruction\n\nshall require that educational instruction and other activities\n\nconducted at the school site are primarily conducted in the native\n\nlanguage;\n\n4. Until June 30, 2023, by the State Board of Education and\n\nbeginning July 1, 2024, by the Statewide Charter School Board when\n\nthe applicant of the charter school is the Office of Juvenile\n\nAffairs or the applicant has a contract with the Office of Juvenile\n\nAffairs and the charter school is for the purpose of providing\n\neducation services to youth in the custody or supervision of the\n\nstate or county;\n\n5. By a federally recognized Indian tribe only when the charter\n\nschool is located within the former reservation or treaty area\n\nboundaries of the tribe on property held in trust by the Bureau of\n\nIndian Affairs of the United States Department of the Interior for\n\nthe benefit of the tribe; or\n\n6. By the Statewide Charter School Board. In counties with a\n\npopulation of fewer than five hundred thousand (500,000), according\n\nto the latest Federal Decennial Census, the Statewide Charter School\n\nBoard shall not sponsor more than five new charter schools each\n\nyear. Existing charter schools sponsored by the Statewide Charter\n\nSchool Board shall not apply to the limits prescribed by this\n\nparagraph.\n\nB. An eligible non-school-district sponsor shall give priority\n\nto opening charter schools that serve at-risk student populations or\n\nstudents from low-performing traditional public schools.\n\nC. An eligible non-school-district sponsor shall give priority\n\nto applicants that have demonstrated a record of operating at least\n\none school or similar program that demonstrates academic success and\n\norganizational viability and serves student populations similar to\n\nthose the proposed charter school seeks to serve. In assessing the\n\npotential for quality replication of a charter school, a sponsor\n\nshall consider the following factors before approving a new site or\n\nschool:\n\n1. Evidence of a strong and reliable record of academic success\n\nbased primarily on student performance data, as well as other viable\n\nindicators including financial and operational success;\n\n2. A sound, detailed, and well-supported growth plan;\n\n3. Evidence of the ability to transfer successful practices to\n\na potentially different context that includes reproducing critical\n\ncultural, organizational, and instructional characteristics;\n\n4. Any management organization involved in a potential\n\nreplication is fully vetted, and the academic, financial, and\n\noperational records of the schools it operates are found to be\n\nsatisfactory;\n\n5. Evidence the program seeking to be replicated has the\n\ncapacity to do so successfully without diminishing or putting at\n\nrisk its current operations; and\n\n6. A financial structure that ensures that funds attributable\non is fully vetted, and the academic, financial, and\n\noperational records of the schools it operates are found to be\n\nsatisfactory;\n\n5. Evidence the program seeking to be replicated has the\n\ncapacity to do so successfully without diminishing or putting at\n\nrisk its current operations; and\n\n6.
