Stat. tit. 70, § 70-3-132.1","heading":"Creation of Statewide Charter School Board —","body":"Termination of Statewide Virtual Charter School Board — Transfer to\n\nStatewide Charter School Board.\n\nA. There is hereby created the Statewide Charter School Board.\n\nBeginning July 1, 2024, the Board shall have the sole authority to\n\nsponsor statewide virtual charter schools in this state and may\n\nsponsor charter schools in this state. The Board shall be composed\n\nof nine (9) voting members as follows:\n\n1. Three members appointed by the Governor;\n\n2. Two members appointed by the President Pro Tempore of the\n\nSenate;\n\n3. Two members appointed by the Speaker of the House of\n\nRepresentatives;\n\n4. The Superintendent of Public Instruction or his or her\n\ndesignee; and\n\n5. The State Auditor and Inspector or his or her designee.\n\nB. Initial appointments shall be made by October 31, 2023. The\n\nPresident Pro Tempore of the Senate and the Speaker of the House of\n\nRepresentatives shall each appoint one member for one (1) year and\n\none member for two (2) years. The Governor shall appoint one member\n\nfor one (1) year and two members for two (2) years. Members shall\n\nserve until their successors are duly appointed for a term of three\n\n(3) years. Appointments shall be made by and take effect on July 31\n\nof the year in which the appointment is made. Annually by December\n\n30 the Board shall elect from its membership a chair and vice chair.\n\nC. A member may be removed from the Board by the appointing\n\nauthority for cause which shall include but not be limited to:\n\n1. Being found guilty by a court of competent jurisdiction of a\n\nfelony or any offense involving moral turpitude;\n\n2. Being found guilty of malfeasance, misfeasance, or\n\nnonfeasance in relation to Board duties;\n\n3. Being found mentally incompetent by a court of competent\n\njurisdiction; or\n\n4. Failing to attend three successive meetings of the Board\n\nwithout just cause, as determined by the Board.\n\nD. Vacancies shall be filled by the appointing authority.\n\nE. No member of the Senate or House of Representatives may be\n\nappointed to the Board while serving as a member of the Legislature\n\nor for two (2) full years following the expiration of the term of\n\noffice.\n\nF. Members of the Statewide Charter School Board shall not\n\nreceive compensation but shall be reimbursed for necessary travel\n\nexpenses pursuant to the provisions of the State Travel\n\nReimbursement Act.\n\nG. The Statewide Charter School Board shall meet at the call of\n\nthe chair. The first meeting of the Board shall be held no later\n\nthan sixty (60) days after the effective date of this act.\n\nH. Five members of the Board shall constitute a quorum, and an\n\naffirmative vote of at least five members shall be required for the\n\nBoard to take any final action.\n\nI. Beginning July 1, 2024, statewide virtual charter schools\n\nshall be sponsored only by the Statewide Charter School Board\n\ncreated pursuant to this section. Effective July 1, 2024, the\n\nStatewide Virtual Charter School Board shall be abolished and the\n\nStatewide Charter School Board shall succeed to any contractual\n\nrights and responsibilities and settlement agreements incurred by\n\nthe Statewide Virtual Charter School Board in a virtual charter\n\nschool sponsorship contract executed prior to July 1, 2024.\n\n1. All powers, duties, responsibilities, policies, personnel,\n\nproperty, equipment, supplies, records, assets, funds, current and\n\nfuture liabilities, encumbrances, obligations, and indebtedness of\n\nthe Statewide Virtual Charter School Board or associated with a\n\nvirtual charter school sponsorship contract entered into by the\n\nStatewide Virtual Charter School Board prior to July 1, 2024, shall\n\nbe transferred to the Statewide Charter School Board. No items\n\nshall be expended or used for any purpose other than the performance\n\nof duties and responsibilities as directed and required in this act.\n\nAppropriate conveyances and other documents shall be executed to\n\neffectuate the transfer of property associated with a sponsorship\newide Virtual Charter School Board prior to July 1, 2024, shall\n\nbe transferred to the Statewide Charter School Board. No items\n\nshall be expended or used for any purpose other than the performance\n\nof duties and responsibilities as directed and required in this act.\n\nAppropriate conveyances and other documents shall be executed to\n\neffectuate the transfer of property associated with a sponsorship\n\ncontract. The Statewide Charter School Board may contract for\n\nadditional legal and administrative services as necessary to\n\neffectuate the transfers provided in this subsection.\n\n2. The Director of the Office of Management and Enterprise\n\nServices shall coordinate the transfer of funds, allotments,\n\npurchase orders, and outstanding financial obligations and\n\nencumbrances relating to the regulation of virtual charter schools\n\nas transferred pursuant to the provisions of this act.\n\n3. Upon succession of sponsorship contracts, the Statewide\n\nCharter School Board shall assume sponsorship of the virtual charter\n\nschools for the remainder of the term of the contracts. Prior to\n\nthe end of the current term of the contract, the Statewide Charter\n\nSchool Board shall allow a virtual charter school to apply for\n\nrenewal of the sponsorship contract in accordance with the renewal\n\nprocedures established pursuant to Section 3-137 of Title 70 of the\n\nOklahoma Statutes.\n\n4. Effective July 1, 2024, all administrative rules promulgated\n\nby the Statewide Virtual Charter School Board relating to the\n\nimplementation and enforcement of the Oklahoma Charter Schools Act\n\nshall be enforceable by the Statewide Charter School Board. The\n\nrules shall continue in force and effect and the Statewide Charter\n\nSchool Board shall have authority to amend, repeal, recodify, or\n\nmake additions to the rules pursuant to the Administrative\n\nProcedures Act.\n\nJ. Effective July 1, 2024, the Statewide Charter School Board\n\nshall succeed to any contractual rights and responsibilities and\n\nsettlement agreements incurred by the State Board of Education in a\n\ncharter school sponsorship contract executed prior to July 1, 2024.\n\nAll property, equipment, supplies, records, assets, funds, current\n\nand future liabilities, encumbrances, obligations, and indebtedness\n\nassociated with a charter school sponsorship contract entered into\n\nby the State Board of Education prior to July 1, 2024, shall be\n\ntransferred to the Statewide Charter School Board. Appropriate\n\nconveyances and other documents shall be executed to effectuate the\n\ntransfer of property associated with a sponsorship contract. Upon\n\nsuccession of sponsorship contracts, the Statewide Charter School\n\nBoard shall assume sponsorship of the charter schools for the\n\nremainder of the term of the contracts. Prior to the end of the\n\ncurrent term of the contract, the Statewide Charter School Board\n\nshall allow a charter school to apply for renewal of the sponsorship\n\ncontract in accordance with the renewal procedures established\n\npursuant to Section 3-137 of Title 70 of the Oklahoma Statutes.\n\nK. Beginning July 1, 2024, at the end of the current term of a\n\ncharter school sponsorship contract with a school district, an\n\naccredited comprehensive or regional institution that is a member of\n\nThe Oklahoma State System of Higher Education, a community college,\n\nor a federally recognized Indian tribe, a charter school may apply\n\nfor contract renewal with the Statewide Charter School Board for\n\nsponsorship.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"fe615235f493cf908235176473912cd8062a51187ff9a2cd11eb053b024f3985","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-3-132","next":"us-ok/okla.-stat.-tit.-70-70-3-132.2"},"notice":"GroundRules: Original legal text.
