Beginning July 1, 2024, and subject to the requirements of\n\nthe Oklahoma Charter Schools Act, the Statewide Charter School Board\n\nshall:\n\n1. Provide supervision, services, and oversight of the\n\noperations of statewide virtual charter schools in this state and\n\ncharter schools for which the Statewide Charter School Board is the\n\nsponsor, recommend legislation pertaining to charter schools to the\n\nLegislature, and promulgate rules and policies that the Board deems\n\nnecessary to accomplish the purposes prescribed in this section;\n\n2. Ensure compliance with state laws and training requirements\n\nfor all charter schools, virtual charter schools, and sponsors;\n\n3. Establish a procedure for accepting, approving, and\n\ndisapproving charter school and statewide virtual charter school\n\napplications and a process for renewal or revocation of approved\n\ncharter contracts which meet the procedures set forth in the\n\nOklahoma Charter Schools Act;\n\n4. Hire an Executive Director and other staff for its\n\noperation;\n\n5. Prepare a budget for expenditures necessary for the proper\n\nmaintenance of the Board and accomplishment of its purpose;\n\n6. Comply with the requirements of the Oklahoma Open Meeting\n\nAct and Oklahoma Open Records Act; and\n\n7. Give priority to opening charter schools and virtual charter\n\nschools that serve at-risk student populations or students from low-\n\nperforming traditional public schools.\n\nB. The State Board of Education shall be responsible for\n\naccreditation of charter schools and virtual charter schools and\n\nensure compliance with special education laws and federal laws and\n\nprograms administered by the State Board of Education.\n\nC. 1. For purposes of the Oklahoma Charter Schools Act,\n\n“charter school” means:\n\na. prior to July 1, 2024, a public school established by\n\ncontract with a school district board of education, a\n\ntechnology center school district, a higher education\n\ninstitution, a federally recognized Indian tribe, or\n\nthe State Board of Education, and\n\nb. on July 1, 2024, and after, a public school\n\nestablished by contract with a school district board\n\nof education, a higher education institution, an\n\ninstitution of higher learning accredited pursuant to\n\nSection 4103 of Title 70 of the Oklahoma Statutes, a\n\nfederally recognized Indian tribe, or the Statewide\n\nCharter School Board,\n\nto provide learning that will improve student achievement and as\n\ndefined in the Elementary and Secondary Education Act of 1965, as\n\nreauthorized by P.L. No. 114-95, also known as the Every Student\n\nSucceeds Act.\n\n2. A charter school may consist of a new school site, new\n\nschool sites, or all or any portion of an existing school site. An\n\nentire school district may not become a charter school site.\n\nD. 1. For the purposes of the Oklahoma Charter Schools Act,\n\n“conversion school” means a school created by converting all or any\n\npart of a traditional public school in order to access any or all\n\nflexibilities afforded to a charter school; provided, however, all\n\nor any part of a traditional public school shall not be converted to\n\na virtual charter school.\n\n2. Prior to the board of education of a school district\n\nconverting all or any part of a traditional public school to a\n\nconversion school, the board shall prepare a conversion plan. The\n\nconversion plan shall include documentation that demonstrates and\n\ncomplies with paragraphs 1, 2, 6, 7, 8, 9, 10, 13, 14, 15, 16, 17,\n\n19, 20, 21, 22, 23, 24, 34, and 35 of subsection B of Section 3-134\n\nof Title 70 of the Oklahoma Statutes. The conversion plan and all\n\ndocuments shall be in writing and shall be available to the public\n\npursuant to the requirements of the Oklahoma Open Records Act. All\n\nvotes by the board of education of a school district to approve a\n\nconversion plan shall be held in an open public session. If the\n, 20, 21, 22, 23, 24, 34, and 35 of subsection B of Section 3-134\n\nof Title 70 of the Oklahoma Statutes. The conversion plan and all\n\ndocuments shall be in writing and shall be available to the public\n\npursuant to the requirements of the Oklahoma Open Records Act. All\n\nvotes by the board of education of a school district to approve a\n\nconversion plan shall be held in an open public session. If the\n\nboard of education of a school district votes to approve a\n\nconversion plan, the board shall notify the State Board of Education\n\nwithin sixty (60) days after the vote. The notification shall\n\ninclude a copy of the minutes for the board meeting at which the\n\nconversion plan was approved.\n\n3. A conversion school shall comply with all the same\n\naccountability measures as are required of a charter school as\n\ndefined in subsection C of this section. The provisions of Sections\n\n3-140 and 3-142 of Title 70 of the Oklahoma Statutes shall not apply\n\nto a conversion school. Conversion schools shall comply with the\n\nsame laws and State Board of Education rules relating to student\n\nenrollment which apply to traditional public schools. Conversion\n\nschools shall be funded by the board of education of the school\n\ndistrict as a school site within the school district and funding\n\nshall not be affected by the conversion of the school.\n\n4. The board of education of a school district may vote to\n\nrevert a conversion school back to a traditional public school at\n\nany time; provided, the change shall only occur during a break\n\nbetween school years.\n\n5. Unless otherwise provided for in this subsection, a\n\nconversion school shall retain the characteristics of a traditional\n\npublic school.\n\nE. 1. Beginning July 1, 2024, the Statewide Charter School\n\nBoard shall make publicly available a list of supplemental online\n\ncourses which have been reviewed and certified by the Board to\n\nensure that the courses are high-quality options and are aligned\n\nwith the subject matter standards adopted by the State Board of\n\nEducation pursuant to Section 11-103.6 of Title 70 of the Oklahoma\n\nStatutes. The Statewide Charter School Board shall give special\n\nemphasis on listing supplemental online courses in science,\n\ntechnology, engineering, and math (STEM), foreign language, and\n\nadvanced placement courses. School districts shall not be limited\n\nto selecting supplemental online courses that have been reviewed and\n\ncertified by the Statewide Charter School Board and listed as\n\nprovided for in this paragraph.\n\n2. In conjunction with the Office of Management and Enterprise\n\nServices, the Board shall negotiate and enter into contracts with\n\nsupplemental online course providers to offer a state rate price to\n\nschool districts for supplemental online courses that have been\n\nreviewed and certified by the Statewide Charter School Board and\n\nlisted as provided for in this subsection.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"44ebc0926f2744a60f2085def96ee7589ca5412f29c4081eaed315e6fbbd5292","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-3-132.1","next":"us-ok/okla.-stat.-tit.-70-70-3-132.3"},"notice":"GroundRules: Original legal text.
