It shall be the duty of each virtual charter school approved\n\nand sponsored by the Statewide Virtual Charter School Board pursuant\n\nto the provisions of Section 3-145.3 of this title to keep a full\n\nand complete record of the attendance of all students enrolled in\n\nthe virtual charter school in one of the student information systems\n\napproved by the State Department of Education and locally selected\n\nby the virtual school from the approved list.\n\nB. By July 1, 2020, the governing body of each virtual charter\n\nschool shall adopt an attendance policy. The policy may allow\n\nattendance to be a proportional amount of the required attendance\n\npolicy provisions based upon the date of enrollment of the student.\n\nThe attendance policy shall include the following provisions:\n\n1. The first date of attendance and membership shall be the\n\nfirst date the student completes an instructional activity.\n\n2. A student who attends a virtual charter school shall be\n\nconsidered in attendance for a quarter if the student:\n\na. completes instructional activities on no less than\n\nninety percent (90%) of the days within the quarter,\n\nb. is on pace for on-time completion of the course as\n\ndefined by the governing board of the virtual charter\n\nschool, or\n\nc. completes no less than seventy-two instructional\n\nactivities within the quarter of the academic year.\n\n3. For a student who does not meet any of the criteria set\n\nforth in paragraph 1 or 2 of this subsection, the amount of\n\nattendance recorded shall be the greater of:\n\na. the number of school days during which the student\n\ncompleted the instructional activities during the\n\nquarter,\n\nb. the number of school days proportional to the\n\npercentage of the course that has been completed, or\n\nc. the number of school days proportional to the\n\npercentage of the required minimum number of completed\n\ninstructional activities during the quarter.\n\nC. For the purposes of this section, \"instructional activities\"\n\nshall include instructional meetings with a teacher, completed\n\nassignments that are used to record a grade for a student that is\n\nfactored into the student's grade for the semester during which the\n\nassignment is completed, testing and school-sanctioned field trips,\n\nand orientation.\n\nD. A student enrolled in a virtual charter school alternative\n\neducation program designated by the State Department of Education\n\nwho attends a full abbreviated school day shall be counted in full\n\nattendance for purposes of computing the average daily attendance\n\nand average daily membership of the virtual charter school. For\n\npurposes of this subsection, \"full abbreviated school day\" shall\n\nmean one hundred eighty-nine (189) hours per quarter or seven\n\nhundred fifty-six (756) hours per school year.\n\nE. Each statewide virtual charter school approved and sponsored\n\nby the Statewide Virtual Charter School Board pursuant to the\n\nprovisions of Section 3-145.3 of this title shall offer a student\n\norientation, notify the parent or legal guardian and each student\n\nwho enrolls in that school of the requirement to participate in the\n\nstudent orientation, and require all students enrolled to complete\n\nthe student orientation prior to completing any other instructional\n\nactivity. The Statewide Virtual Charter School Board shall\n\npromulgate rules to develop materials for orientation.\n\nF. Any student who is behind pace and does not complete an\n\ninstructional activity for fifteen (15) consecutive days, including\n\nweekends, shall be withdrawn for truancy. The virtual charter\n\nschool shall submit a notification to the parent or legal guardian\n\nof a student who has been withdrawn for truancy or is approaching\n\ntruancy.\n\nG. 1. Except as provided in paragraph 2 of this subsection, a\n\nstudent who is reported for truancy two times in the same school\n\nyear shall be withdrawn and prohibited from enrolling in the same\nual charter\n\nschool shall submit a notification to the parent or legal guardian\n\nof a student who has been withdrawn for truancy or is approaching\n\ntruancy.\n\nG. 1. Except as provided in paragraph 2 of this subsection, a\n\nstudent who is reported for truancy two times in the same school\n\nyear shall be withdrawn and prohibited from enrolling in the same\n\nvirtual charter school for the remainder of the school year.\n\n2. If a student is enrolled in a virtual charter school\n\nalternative education program designated by the State Department of\n\nEducation, the virtual charter school may request a waiver of the\n\nenrollment prohibition from the Department on behalf of a student\n\nenrolled at the virtual charter school who is reported for truancy\n\ntwo times in the same school year. The office of accreditation\n\nshall review the waiver request and determine whether the student\n\nshould be allowed to continue attending the virtual charter school.\n\nThe student shall continue attending the virtual charter school\n\nwhile the waiver is being reviewed and until a final determination\n\nis made.\n\nH. The governing body of each statewide virtual charter school\n\nshall develop, adopt and post on the school's website a policy\n\nregarding consequences for a student's failure to attend school and\n\ncomplete instructional activities. The policy shall state, at a\n\nminimum, that if a student fails to consistently attend school and\n\ncomplete instructional activities after receiving a notification\n\npursuant to subsection F of this section and reasonable intervention\n\nstrategies have been implemented, a student shall be subject to\n\ncertain consequences including withdrawal from the school for\n\ntruancy.\n\nI. If a statewide virtual charter school withdraws a student\n\npursuant to subsections G and H of this section, the virtual charter\n\nschool shall immediately notify the student's resident district in\n\nwriting of the student's disenrollment.\n\nJ. The provisions of subsections G, H, and I of this section\n\nshall not be in effect until the implementation of subsection H of\n\nSection 3-145.3 of this title.\n\nK.
