There is hereby re-created to continue until July 1, 2026,\n\nin accordance with the provisions of the Oklahoma Sunset Law, the\n\nOklahoma Advisory Council on Indian Education.\n\nB. The Council shall:\n\n1. Make recommendations to the State Board of Education and the\n\nSuperintendent of Public Instruction in educational matters\n\naffecting the education of Native American students;\n\n2. Promote educational opportunities and improvement of the\n\nquality of education provided to Native American students throughout\n\nthe state;\n\n3. Advocate for Native American students in the state; and\n\n4. Monitor and evaluate how the public education system of the\n\nstate impacts Native American students.\n\nC. The Council shall be composed of eighteen (18) members as\n\nfollows:\n\n1. Five members who shall each represent an Indian tribe in the\n\nstate, of which at least one shall represent an Indian tribe which\n\nhas an enrollment of less than ten thousand (10,000) members who\n\nreside in the state, appointed by the Speaker of the House of\n\nRepresentatives from a list of nominations submitted by the elected\n\nexecutive leaders of different Indian tribes in the state;\n\n2. Four members who shall each represent the tribal education\n\ndepartments of an Indian tribe in the state, appointed by the\n\nPresident Pro Tempore of the Senate from a list of nominations\n\nsubmitted by the elected executive leaders of different Indian\n\ntribes in the state;\n\n3. One member who shall represent the Oklahoma Council for\n\nIndian Education, appointed by the Governor;\n\n4. Two members who shall represent two different statewide\n\norganizations representing public school teachers, appointed by the\n\nPresident Pro Tempore of the Senate;\n\n5. One member who shall represent a statewide organization\n\nrepresenting public school superintendents, appointed by the Speaker\n\nof the House of Representatives;\n\n6. One member who shall represent Oklahoma tribal colleges,\n\nappointed by the Chancellor of Higher Education;\n\n7. The Director of the Native American Cultural and Educational\n\nAuthority, or designee;\n\n8. The Chancellor of Higher Education, or designee;\n\n9. The Director of the Oklahoma Department of Career and\n\nTechnology Education, or designee; and\n\n10. The Superintendent of Public Instruction, or designee.\n\nD. Appointments to the Council shall be made by September 1,\n\n2023. The first meeting of the Council shall be called by the\n\nSuperintendent of Public Instruction. At the first meeting, the\n\nmembers of the Council shall elect a chair and vice chair from among\n\nthe members. Meetings of the Council shall be held at least\n\nquarterly at the call of the chair. Members shall serve at the\n\npleasure of their appointing authorities. A majority of the members\n\nof the Council shall constitute a quorum to transact business, but\n\nno vacancy shall impair the right of the remaining members to\n\nexercise all of the powers of the Council. A vacancy on the Council\n\nshall be filled by the original appointing authority. A vacancy on\n\nthe Council in a seat representing an Indian tribe in the state or\n\nthe tribal education department of an Indian tribe in the state may\n\nbe filled by the original appointing authority from a list of\n\nnominations submitted by the elected executive leaders of Indian\n\ntribes in the state. Appointments to fill any vacancy on the\n\nCouncil shall be made within three (3) months following the vacancy.\n\nThe State Department of Education, Oklahoma Department of Career and\n\nTechnology Education, and the Oklahoma State Regents for Higher\n\nEducation shall provide staff, support, and information as requested\n\nby the Council.\n\nE. Members of the Council shall receive no compensation for\n\nserving on the Council but shall receive travel reimbursement as\n\nfollows:\n\n1. State employees who are members of the Council shall be\n\nreimbursed for travel expenses incurred in the performance of their\n\nEducation shall provide staff, support, and information as requested\n\nby the Council.\n\nE. Members of the Council shall receive no compensation for\n\nserving on the Council but shall receive travel reimbursement as\n\nfollows:\n\n1. State employees who are members of the Council shall be\n\nreimbursed for travel expenses incurred in the performance of their\n\nduties by their respective agencies in accordance with the State\n\nTravel Reimbursement Act; and\n\n2. All other members of the Council shall be reimbursed by the\n\nOffice of Management and Enterprise Services for travel expenses\n\nincurred in the performance of their duties in accordance with the\n\nState Travel Reimbursement Act.\n\nF. The Council shall act in accordance with the provisions of\n\nthe Oklahoma Open Meeting Act and the Oklahoma Open Records Act.\n\nG. Members who serve on the Council shall be exempt from the\n\ndual-office-holding prohibitions of Section 6 of Title 51 of the\n\nOklahoma Statutes.\n\nH. The Council shall have the following duties:\n\n1. Identify strategies for developing an efficient and reliable\n\nprocess of communications between Oklahoma education entities,\n\neducators, tribal organizations, and other interested parties;\n\n2. Identify and disseminate research-based, measurable\n\ncriteria, both behavioral and academic, by which the success and\n\nefficacy of the education offered to Native American students in\n\nOklahoma may be measured;\n\n3. Analyze data to ensure that education agencies in Oklahoma\n\ncontinue to address the education needs of Native American students;\n\n4. Encourage and promote Native American educational leadership\n\nat all levels of the education system; and\n\n5. Make recommendations to the State Board of Education for\n\nprograms that will help achieve the purposes of the Oklahoma\n\nAdvisory Council on Indian Education Act.\n\nI. The Council shall evaluate and make an annual report on the\n\neffectiveness of the public education system in Oklahoma in meeting\n\nthe needs of Native American students in Oklahoma. The report shall\n\nbe submitted to the State Board of Education.
