Stat. tit. 70, § 70-3210","heading":"Appropriations - Allocations - Allotments - Reports","body":"(a) All appropriations made by the Legislature for state\n\neducational institutions of the State System shall be made to the\n\nState Regents in consolidated form, indicating the amount\n\nappropriated from the General Revenue Fund and each special fund,\n\nwithout reference to the amount appropriated to any particular\n\ninstitution. On April 1 of each year, or as soon thereafter as\n\npossible, but not later than June 15 of each year, the State Regents\n\nshall certify to the Director of the Office of Management and\n\nEnterprise Services such portions of the consolidated appropriation\n\nas they shall have allocated to each institution from the General\n\nRevenue Fund and each special fund for the next fiscal year and the\n\namount of the allocation for each institution which is to be\n\nreserved for the purpose authorized by subsection B of Section 34.53\n\nof Title 62 of the Oklahoma Statutes. The Director of the Office of\n\nManagement and Enterprise Services shall allocate the revenue\n\ndeposited in the State Treasury to the credit of the General Revenue\n\nFund to a cash account for each institution or special\n\nappropriation, and to any unallocated portion of such consolidated\n\nappropriations, on a percentage basis in the same manner as provided\n\nby law for allocations of cash to Legislative appropriations for\n\nother departments and institutions.\n\n(b) The State Regents may make additional allocations from the\n\nconsolidated appropriation to any institution during the year but\n\nthey shall not decrease the amount allocated to any institution\n\nduring the year. Where an additional allocation is made to an\n\ninstitution, the Director of the Office of Management and Enterprise\n\nServices shall make such adjustment by decreasing the consolidated\n\nappropriation balance and increasing the appropriation of the\n\ninstitution or institutions to which the additional allocation is\n\nmade. At the same time he shall make an adjustment between the cash\n\naccounts by reducing the consolidated cash account and increasing\n\nthe institution's cash account, giving the institution or\n\ninstitutions credit in cash for that portion of revenue which has\n\nalready been allocated to that portion of the consolidated\n\nappropriation transferred, thereby transferring the percentage of\n\ncash which belongs to the additional allocation made from the\n\nconsolidated appropriation. Thereafter, the Director of the Office\n\nof Management and Enterprise Services shall increase the revenue\n\nallocations to each of the educational institutions which have\n\nreceived additional allocations so that such allocations shall take\n\ninto consideration the original allocation plus the additional\n\nallocation from the consolidated appropriation. The State Regents\n\nmay make additional allocations each month of the fiscal year but\n\nsuch allocations for all institutions shall be certified to the\n\nDirector of the Office of Management and Enterprise Services at the\n\nsame time and shall not take effect until the first day of the month\n\nfollowing the month in which such additional allocations are\n\ncertified to the Director of the Office of Management and Enterprise\n\nServices. The cash allocated to all of the institutions shall never\n\nexceed the amount of revenue which would have been allocated to the\n\nconsolidated appropriation had such consolidated appropriation never\n\nbeen divided. The division of cash among the several institutions\n\nshall be considered a division of the revenue which would have been\n\nallocated to the consolidated account.\n\n(c) Both the cash allocations and the appropriation allotments\n\nshall be considered cumulative in that the balance unexpended or\n\nunencumbered at the end of any month of the fiscal year shall add to\n\nthe amount allocated during the subsequent months so that the fiscal\n\nyear shall be considered as a unit.\ndered a division of the revenue which would have been\n\nallocated to the consolidated account.\n\n(c) Both the cash allocations and the appropriation allotments\n\nshall be considered cumulative in that the balance unexpended or\n\nunencumbered at the end of any month of the fiscal year shall add to\n\nthe amount allocated during the subsequent months so that the fiscal\n\nyear shall be considered as a unit.\n\n(d) The appropriations allocated by the State Regents to each\n\ninstitution for the year on June 15 shall be set up in the same\n\nmanner as other departments and institutions for contractual\n\npurposes except as otherwise provided in this section.\n\n(e) Financial documents arising from the appropriation\n\nallocations to each institution shall be filed with the Director of\n\nthe Office of Management and Enterprise Services in the same manner\n\nand at the same time as is now provided by law.\n\n(f) Nothing contained in this section shall be construed to\n\nchange existing laws relating to the apportionment of cash to\n\nSection 13 or New College Funds for each of the institutions which\n\nunder present laws receive monies from such sources. Provided, that\n\nnothing herein shall be construed to give the State Regents\n\nauthority to take money from the revolving fund of one institution\n\nand give it to another institution. Revolving funds of all of the\n\nconstituent institutions shall operate as a continuing appropriation\n\nunder the law creating each such revolving fund which allocates the\n\nrevenue collected by each such institution to the revolving fund of\n\nthat institution. None of such institutions shall incur obligations\n\nagainst such revolving fund in excess of the unencumbered balance of\n\nsurplus cash on hand. Such revolving funds shall be nonfiscal year\n\nappropriations, and shall be disbursed by warrants issued by the\n\nState Treasurer.\n\n(g) No expenditure from any of the revolving funds of the\n\nvarious institutions shall be made for any purpose, except that for\n\nwhich said portion of said fund was specifically collected;\n\nprovided, that when any portion of any of such revolving funds shall\n\nnot be needed for the purpose for which the same was collected, the\n\nState Regents may, upon the request of the Board of Regents of any\n\ninstitution, authorize such Board of Regents to expend such unneeded\n\nbalance of such revolving fund for any other purpose which, in the\n\nopinion of the State Regents, shall be necessary or desirable in the\n\nconduct of such institution.\n\n(h) The Director of the Office of Management and Enterprise\n\nServices shall make monthly reports to the institutions and agencies\n\ncomprising the State System indicating, by classification of funds,\n\nthe amounts allotted by the State Regents, the cumulative\n\nexpenditures at the end of each month, the unexpended balances, the\n\nencumbrances outstanding, and the unencumbered balances at the end\n\nof the month.\n\n(i) The State Regents shall direct the disposition of such\n\nfunds as the Legislature shall appropriate, which funds shall be\n\nallocated to the state educational institutions entitled thereto\n\nunder the provisions of, and in accordance with, the Enabling Act\n\nand the Constitution of the State of Oklahoma, for the support of\n\nsuch state educational institutions.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"59f36a489e289788d135df20f573df57b5a467c81a5543fb836f4af3ae436f29","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-3209","next":"us-ok/okla.-stat.-tit.-70-70-3211"},"notice":"GroundRules: Original legal text.
