Subject to the provisions of subsection D of this section,\n\nthe Oklahoma State Regents for Higher Education are authorized to\n\nestablish undergraduate resident tuition, nonresident tuition and\n\nmandatory fees, which students shall pay as a condition of\n\nenrollment, except as otherwise provided by law. The process for\n\nestablishing tuition and mandatory fees shall incorporate the\n\nprovisions of Section 3218.14 of this title.\n\n1. At the comprehensive universities the combined average of\n\nthe resident tuition and mandatory fees established for any school\n\nyear for the nonguaranteed rate, as determined by the State Regents,\n\nshall remain less than the combined average of the resident tuition\n\nand fees at the state-supported institutions of higher education\n\nthat are members of the Big Twelve Conference on the effective date\n\nof this act. The combined average of the nonresident tuition and\n\nmandatory fees, as determined by the State Regents, shall remain\n\nless than one hundred five percent (105%) of the combined average of\n\nthe nonresident tuition and fees at the state-supported institutions\n\nof higher education that are members of the Big Twelve Conference on\n\nthe effective date of this act.\n\n2. At the regional universities and two-year colleges the\n\ncombined average of the resident tuition and mandatory fees\n\nestablished for any school year for the nonguaranteed rate, as\n\ndetermined by the State Regents, shall remain less than the combined\n\naverage of the resident tuition and mandatory fees at like-type\n\nstate-supported institutions of higher education in states\n\ndetermined by the State Regents that include, but are not limited\n\nto, those adjacent to Oklahoma. The combined average of the\n\nnonresident tuition and mandatory fees, as determined by the State\n\nRegents, shall remain less than one hundred five percent (105%) of\n\nthe combined average of the nonresident tuition and fees at like-\n\ntype state-supported institutions of higher education in states\n\ndetermined by the State Regents that include, but are not limited\n\nto, those adjacent to Oklahoma.\n\nB. In its deliberation on the establishment of resident tuition\n\nrates for undergraduate and graduate education, the Oklahoma State\n\nRegents for Higher Education shall balance the affordability of\n\npublic higher education with the provision of available, diverse and\n\nhigh-quality learning opportunities. In this endeavor the State\n\nRegents shall give consideration to the level of state\n\nappropriations, the state economy, the per capita income and cost of\n\nliving, the college-going and college-retention rates, and the\n\navailability of financial aid in Oklahoma. For any increase in the\n\ntuition rates, the State Regents shall demonstrate a reasonable\n\neffort to effect a proportionate increase in the availability of\n\nneed-based student financial aid. Need-based financial aid shall\n\ninclude, but shall not be limited to, awards for the Oklahoma Higher\n\nLearning Access Program, Oklahoma Tuition Aid Grants, federal need-\n\nbased financial aid and tuition waivers, and private donations. In\n\naddition, when determining the guaranteed tuition rates as provided\n\nfor in subsection D of this section, the Regents shall consider the\n\nanticipated revenue needs during the four-year period of the\n\nguarantee.\n\nC. Students permitted to audit courses shall pay the same\n\nresident tuition and nonresident tuition as required of students who\n\nenroll for course credit.\n\nD. 1. Beginning with the 2008-2009 academic year, each\n\ncomprehensive and regional institution within The Oklahoma State\n\nSystem of Higher Education shall offer to resident students\n\nenrolling for the first time as a full-time undergraduate a tuition\n\nrate that will be guaranteed for a period of not less than four (4)\n\nconsecutive academic years as provided for in this subsection.\n\n09 academic year, each\n\ncomprehensive and regional institution within The Oklahoma State\n\nSystem of Higher Education shall offer to resident students\n\nenrolling for the first time as a full-time undergraduate a tuition\n\nrate that will be guaranteed for a period of not less than four (4)\n\nconsecutive academic years as provided for in this subsection.\n\nStudents shall have the option to participate or not participate in\n\nthe guaranteed tuition rate program and shall indicate their\n\nelection at the time of enrollment. Each institution shall provide\n\nstudents with the following information prior to enrollment:\n\na. the annual tuition rate charged and the percentage\n\nincrease for the previous four (4) academic years, and\n\nb. the annual tuition and percentage increase that the\n\nnonguaranteed tuition rate would have to increase to\n\nequal or exceed the guaranteed tuition rate for the\n\nsucceeding four (4) academic years.\n\n2. Except as otherwise provided for in this subsection, for a\n\nstudent who elects to participate in the guaranteed tuition rate\n\nprogram, who is a resident of the state, and who enrolls for the\n\nfirst time as a full-time undergraduate student at an institution in\n\nthe state after the 2007-2008 academic year, the amount of\n\nundergraduate resident tuition charged to the student for four (4)\n\nconsecutive academic years at a comprehensive and regional\n\ninstitution shall not exceed the amount that the student was charged\n\nat the time of first enrollment, nor shall it exceed one hundred\n\nfifteen percent (115%) of the nonguaranteed undergraduate tuition\n\nrate charged to resident students enrolling for the first time as\n\nundergraduate students at the same institution for the same academic\n\nyear.\n\n3. If the normal time of completion for an undergraduate\n\nprogram is more than four (4) years, as determined by the\n\ninstitution, the amount of resident tuition charged to students in\n\nthat program who have elected to participate in the guaranteed\n\ntuition rate program shall not increase during the normal completion\n\nperiod of the program.\n\n4. If a student who has elected to participate in the\n\nguaranteed tuition rate program is a member of the United States\n\nArmed Forces including the Army and Air National Guard, the Army,\n\nNavy, Air Force, Marine Corps, and Coast Guard Reserves, or any\n\nother component of the Armed Forces, and when ordered by the proper\n\nauthority to active or inactive duty or service is required to\n\nwithdraw from an institution for military or other national defense\n\nemergencies, the amount of resident tuition the student is required\n\nto pay upon reentering the institution shall not exceed the amount\n\nthe student was charged at the time of withdrawal.\n\n5. If a student who has elected to participate in the\n\nguaranteed tuition rate program transfers to another institution or\n\ntransfers from a constituent agency of an institution to another\n\nconstituent agency or the institution after initial enrollment, the\n\nstudent shall be charged the amount of resident tuition charged to\n\nother students enrolling for the first time at that institution or\n\nconstituent agency.\n\n6. If a student who has elected to participate in the\n\nguaranteed tuition rate program changes majors or transfers to\n\nanother campus of the same institution after initial enrollment, the\n\ntuition charged to the student shall equal the amount the student\n\nwould have been charged had the student been admitted to the changed\n\nmajor or enrolled at the new campus when the student first enrolled.\n\nThis paragraph shall not apply if a student transfers from a\n\nconstituent agency of an institution to another constituent agency\n\nof the institution.\n\n7. A student who elects to participate in the guaranteed\n\ntuition rate program shall maintain full-time enrollment during the\n\nguaranteed four-year period. For purposes of this subsection, full-\ned at the new campus when the student first enrolled.\n\nThis paragraph shall not apply if a student transfers from a\n\nconstituent agency of an institution to another constituent agency\n\nof the institution.\n\n7. A student who elects to participate in the guaranteed\n\ntuition rate program shall maintain full-time enrollment during the\n\nguaranteed four-year period.
