This act shall be known and may be cited as the \"Oklahoma\n\nNational Guard Educational Assistance Act\".\n\nB. As used in this act:\n\n1. \"Oklahoma educational institution\" means an institution of\n\nhigher education within The Oklahoma State System of Higher\n\nEducation;\n\n2. \"Eligible Guard member\" means a current member of the\n\nOklahoma National Guard in good standing who has a high school\n\ndiploma or who has completed General Educational Development (GED)\n\nrequirements and who has secured admission to and enrolled in an\n\nOklahoma educational institution;\n\n3. \"Graduate program\" means a program offered by an Oklahoma\n\neducational institution that leads to the award of a master's\n\ndegree;\n\n4. \"Program\" means the Oklahoma National Guard Educational\n\nAssistance Program established pursuant to the provisions of this\n\nsection; and\n\n5. \"Undergraduate program\" means a program offered by an\n\nOklahoma educational institution that leads to the award of an\n\nassociate's degree or a baccalaureate degree.\n\nC. There is hereby created the Oklahoma National Guard\n\nEducational Assistance Program to provide assistance to eligible\n\nGuard members who enroll in an Oklahoma educational institution.\n\nSubject to the availability of funds, the amount of assistance shall\n\nbe equivalent to the amount of resident tuition and approved\n\nmandatory fees, program fees, academic service fees, and any other\n\nfees for courses in which the eligible Guard member is enrolled, not\n\nto exceed a maximum of eighteen (18) credit hours each semester.\n\nThe amount of mandatory fees, program fees, academic service fees,\n\nand any other fees shall be jointly reviewed and approved by the\n\nOklahoma State Regents for Higher Education and the Military\n\nDepartment of the State of Oklahoma before a determination to pay\n\nthe fees is made.\n\n1. The amount of assistance provided to an eligible Guard\n\nmember enrolled in an undergraduate program shall not exceed a\n\nmaximum of one hundred twenty (120) credit hours in pursuit of an\n\nassociate's degree and/or a baccalaureate degree.\n\n2. Subject to the assistance for eligible Guard members\n\nenrolled in undergraduate programs being fully funded, assistance\n\nshall be provided to an eligible Guard member with a baccalaureate\n\ndegree enrolled in a graduate program. The amount of assistance\n\nprovided to an eligible Guard member enrolled in a graduate program\n\nshall not exceed a maximum of forty (40) credit hours in pursuit of\n\na master's degree.\n\n3. Assistance provided pursuant to this section shall be\n\ngranted without any limitation other than the amount of funds\n\navailable for the Program and the number of eligible Guard members\n\nwho apply, subject to any cap established by the Military\n\nDepartment.\n\n4. Assistance allowed by this section shall not be allowed for\n\ncourses taken in excess of the requirements for completion of an\n\nundergraduate program or a graduate program, whichever is applicable\n\nfor the eligible Guard member.\n\nD. Assistance provided pursuant to this section shall be\n\nallocated to the Oklahoma educational institution from the Oklahoma\n\nNational Guard Educational Assistance Revolving Fund created\n\npursuant to Section 3232 of this title.\n\nE. To be eligible to apply for the Program, an eligible Guard\n\nmember shall:\n\n1. Have at least one (1) year remaining on his or her\n\nenlistment contract at the beginning of any semester for which the\n\nmember applies for assistance pursuant to this section;\n\n2. Agree in writing to complete his or her current service\n\nobligation in the Oklahoma National Guard; and\n\n3. Agree in writing to serve actively in good standing with the\n\nOklahoma National Guard for not less than twenty-four (24) months\n\nafter completion of the last semester for which the member receives\n\nassistance pursuant to this section.\n\nF. To retain eligibility for the Program, an eligible Guard\n\nmember shall:\no complete his or her current service\n\nobligation in the Oklahoma National Guard; and\n\n3. Agree in writing to serve actively in good standing with the\n\nOklahoma National Guard for not less than twenty-four (24) months\n\nafter completion of the last semester for which the member receives\n\nassistance pursuant to this section.\n\nF. To retain eligibility for the Program, an eligible Guard\n\nmember shall:\n\n1. Maintain good academic standing and satisfactory academic\n\nprogress according to standards of the Oklahoma educational\n\ninstitution in which the member is enrolled;\n\n2. Maintain the requirements for retention and degree\n\ncompletion as established by the Oklahoma educational institution in\n\nwhich the member is enrolled;\n\n3. Maintain a minimum grade point average of 2.0 on a 4.0\n\nscale;\n\n4. Maintain satisfactory participation in the Oklahoma National\n\nGuard; and\n\n5. Possess a Military Occupational Specialty (MOS) or Air Force\n\nSpecialty Code (AFSC) after his or her first semester.\n\nG. An eligible Guard member seeking assistance pursuant to the\n\nprovisions of this section shall submit an application on a form\n\nprescribed by the Military Department of the State of Oklahoma to\n\nthe Educational Service Office of the Military Department prior to\n\nthe semester for which assistance is sought. The Military\n\nDepartment may establish a cap on the number of eligible Guard\n\nmembers allowed to participate per semester per undergraduate or\n\ngraduate program. The eligible Guard member's Commander or his or\n\nher designee shall confirm a member's standing and eligibility to\n\nthe Oklahoma educational institution in which the student is\n\nenrolled.\n\nH. The eligible Guard member's Commander may deny an\n\napplication submitted by an eligible Guard member for continued\n\nProgram assistance if he or she fails to comply with the provisions\n\nof paragraph 1, 2, 3, 4, or 5 of subsection F of this section.\n\nI. An eligible Guard member who has received Program assistance\n\npursuant to the provisions of this section and who fails to comply\n\nwith the provisions of paragraph 4 of subsection F of this section\n\nshall be required to repay an amount to be calculated as follows:\n\n1. Determine the total amount of assistance provided pursuant\n\nto the provisions of this section;\n\n2. Divide the amount determined in paragraph 1 of this\n\nsubsection by twenty-four (24); and\n\n3. Multiply the amount determined in paragraph 2 of this\n\nsubsection by the number of months the member did not fulfill the\n\nrequirements of paragraph 4 of subsection F of this section.\n\nRepayments shall be deposited into the Oklahoma National Guard\n\nEducational Assistance Revolving Fund created pursuant to Section\n\n3232 of this title.\n\nJ. An eligible Guard member who has received Program assistance\n\npursuant to the provisions of this section and who fails to comply\n\nwith the provisions of paragraph 4 of subsection F of this section\n\ndue to hardship circumstances may request a waiver from repayment.\n\nA waiver request shall be submitted in writing to the Adjutant\n\nGeneral.\n\nK. By July 1 annually, the Oklahoma State Regents for Higher\n\nEducation shall notify the Adjutant General of the amount of funding\n\navailable in the Oklahoma National Guard Educational Assistance\n\nRevolving Fund created pursuant to Section 3232 of this title.\n\nL. The Oklahoma State Regents for Higher Education shall\n\npromulgate rules to implement the provisions of this act including\n\ndeadlines for submission of applications required by subsection G of\n\nthis section. The Military Department of the State of Oklahoma\n\nshall promulgate regulations pertaining to the application process\n\nand the determination of eligibility for the assistance program.\n\nThe Oklahoma State Regents for Higher Education and Military\n\nDepartment shall coordinate the promulgation of rules and\n\nregulations to ensure compatibility. The Adjutant General may\n\npromulgate regulations to implement the provisions of this act.\nState of Oklahoma\n\nshall promulgate regulations pertaining to the application process\n\nand the determination of eligibility for the assistance program.\n\nThe Oklahoma State Regents for Higher Education and Military\n\nDepartment shall coordinate the promulgation of rules and\n\nregulations to ensure compatibility.
