Stat. tit. 70, § 70-3241.1","heading":"Instructional materials – Costs, purchasing, and","body":"definitions.\n\nA. It is the intent of the Legislature to:\n\n1. Give students enrolled in institutions in The Oklahoma State\n\nSystem of Higher Education more choices for purchasing textbooks and\n\ninstructional materials;\n\n2. Encourage higher education faculty and staff to work closely\n\nwith bookstores and publishers to implement the least costly option\n\nwithout sacrificing educational content; and\n\n3. Provide maximum cost savings to students.\n\nB. As used in this section:\n\n1. \"Instructional material\" means any textbooks, workbooks, CD-\n\nROMs, and other course-related material that are published with the\n\nintent that they be used for or in conjunction with classroom\n\ninstruction and that are adopted for academic use by the faculty or\n\nthe person or entity in charge of selecting learning materials at\n\nthe institution within The Oklahoma State System of Higher\n\nEducation;\n\n2. \"Bundled\" means a textbook and other supplemental\n\ninstructional materials that may be packaged together to be sold as\n\ncourse materials for one price but shall not include integrated\n\ntextbooks that cannot be sold separately due to third-party\n\ncontractual agreements, custom editions, or special editions;\n\n3. “Integrated textbook” means a textbook that:\n\na. is combined with materials developed by a third party\n\nand that, by third-party contractual agreement, may\n\nnot be offered by publishers separately from the\n\ntextbook with which the materials are combined, or\n\nb. is combined with other materials that are so\n\ninterrelated with the intent of the textbook that the\n\nseparation of the textbook from the other materials\n\nwould render the textbook unusable for its intended\n\npurpose; and\n\n4. “Custom edition” means instructional material that is\n\ncompiled by a publisher at the direction of a faculty member or\n\nother person or adopting entity in charge of selecting course\n\nmaterials at an institution, and may include, alone or in\n\ncombination, items such as selections from original instructor\n\nmaterials, previously copyrighted publisher materials, copyrighted\n\nthird-party works, and elements unique to a specific institution,\n\nsuch as commemorative editions.\n\nC. Each board of regents of an institution or group of\n\ninstitutions within The Oklahoma State System of Higher Education\n\nshall adopt an instructional material policy that requires:\n\n1. Bookstores located on campus or bookstores which contract\n\nwith the institution to provide bookstore services to students to:\n\na. provide students with the option of purchasing\n\ninstructional materials that are unbundled when\n\npossible, disclose to faculty and staff the costs to\n\nstudents of purchasing instructional materials, and\n\ndisclose publicly how new editions vary from previous\n\neditions,\n\nb. actively promote and publicize book buy-back programs,\n\nand\n\nc. disclose retail costs for instructional materials on a\n\nper-course basis to faculty and staff and make this\n\ninformation publicly available; and\n\n2. Higher education faculty and staff members to consider the\n\nleast costly practices in assigning instructional materials for a\n\ncourse, such as adopting the least expensive edition available when\n\neducational content is comparable as determined by the faculty and\n\nworking closely with publishers and bookstores to create bundles and\n\npackages if they deliver cost savings to students.\n\nD. In developing an instructional material policy as required\n\nin subsection C of this section, each board of regents shall work\n\nwith and seek input from bookstores, publishers, students and\n\nfaculty representatives.\n\nE. Each publisher of instructional material used by students\n\nenrolled at institutions in The Oklahoma State System of Higher\n\nEducation shall make available to the faculty and staff of that\n\ninstitution the:\n\n1. Price at which the publisher will make the instructional\n\nmaterials available to bookstores, either those located on campus of\nkstores, publishers, students and\n\nfaculty representatives.\n\nE. Each publisher of instructional material used by students\n\nenrolled at institutions in The Oklahoma State System of Higher\n\nEducation shall make available to the faculty and staff of that\n\ninstitution the:\n\n1. Price at which the publisher will make the instructional\n\nmaterials available to bookstores, either those located on campus of\n\nthe institution or those which have a contract with the institution\n\nto provide bookstore services to students; and\n\n2.
