Stat. tit. 70, § 70-3242","heading":"Eligibility for enrollment and resident tuition -","body":"Immigrant status - Scholarships and financial aid.\n\nA. The Oklahoma State Regents for Higher Education may adopt a\n\npolicy which allows a student to enroll in an institution within The\n\nOklahoma State System of Higher Education and allows a student to be\n\neligible for resident tuition if the student:\n\n1. Graduated from a public or private high school in this\n\nstate; and\n\n2. Resided in this state with a parent or legal guardian while\n\nattending classes at a public or private high school in this state\n\nfor at least two (2) years prior to graduation.\n\nB. To be eligible for the provisions of subsection A of this\n\nsection, an eligible student shall:\n\n1. Satisfy admission standards as determined by the Oklahoma\n\nState Regents for Higher Education for the appropriate type of\n\ninstitution and have secured admission to, and enrolled in, an\n\ninstitution within The Oklahoma State System of Higher Education;\n\nand\n\n2. If the student cannot present to the institution valid\n\ndocumentation of United States nationality or an immigration status\n\npermitting study at a postsecondary institution:\n\na. provide to the institution a copy of a true and\n\ncorrect application or petition filed with the United\n\nStates Citizenship and Immigration Services to\n\nlegalize the student’s immigration status, or\n\nb. file an affidavit with the institution stating that\n\nthe student will file an application to legalize his\n\nor her immigration status at the earliest opportunity\n\nthe student is eligible to do so, but in no case later\n\nthan:\n\n(1) one (1) year after the date on which the student\n\nenrolls for study at the institution, or\n\n(2) if there is no formal process to permit children\n\nof parents without lawful immigration status to\n\napply for lawful status without risk of\n\ndeportation, one (1) year after the date the\n\nUnited States Citizenship and Immigration\n\nServices provide such a formal process, and\n\nc. if the student files an affidavit pursuant to\n\nsubparagraph b of this paragraph, present to the\n\ninstitution a copy of a true and correct application\n\nor petition filed with the United States Citizenship\n\nand Immigration Services no later than:\n\n(1) one (1) year after the date on which the student\n\nenrolls for study at the institution, or\n\n(2) if there is no formal process to permit children\n\nof parents without lawful immigration status to\n\napply for lawful status without risk of\n\ndeportation, one (1) year after the date the\n\nUnited States Citizenship and Immigration\n\nServices provide such a formal process, which\n\ncopy shall be maintained in the institution's\n\nrecords for that student.\n\nC. Any student who completes the required criteria prescribed\n\nin subsection A of this section, paragraph 1 of subsection B of this\n\nsection, and subparagraph a of paragraph 2 of subsection B of this\n\nsection shall not be disqualified on the basis of the student’s\n\nimmigration status from any scholarships or financial aid provided\n\nby this state.\n\nD. The provisions of this section shall not impose any\n\nadditional conditions to maintain resident tuition status at a\n\npostsecondary educational institution within The Oklahoma State\n\nSystem of Higher Education on a student who was enrolled in a degree\n\nprogram and first received such resident tuition status at that\n\ninstitution during the 2006-2007 school year or any prior year.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"758d057938d92688e9dcf14b60eb3eddd8e2187472f548b417cad448d44359ab","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-3241.2","next":"us-ok/okla.-stat.-tit.-70-70-3242.2"},"notice":"GroundRules: Original legal text.
