No institution of higher education within The Oklahoma State\n\nSystem of Higher Education shall utilize state funds, property, or\n\nresources to:\n\n1. Grant or support diversity, equity, and inclusion positions,\n\ndepartments, activities, procedures, or programs to the extent they\n\ngrant preferential treatment based on one person’s particular race,\n\ncolor, ethnicity, or national origin over another’s;\n\n2. Mandate any person to participate in, listen to, or receive\n\nany education, training, activities, procedures, or programming to\n\nthe extent such education, training, activities, procedures, or\n\nprogramming grants preferences based on one person’s particular\n\nrace, color, sex, ethnicity, or national origin over another’s;\n\n3. Mandate any person swear, certify, or agree to any loyalty\n\noath that favors or prefers one particular race, color, sex,\n\nethnicity, or national origin over another’s;\n\n4. Mandate any person to certify or declare agreement with,\n\nrecognition of, or adherence to any particular political,\n\nphilosophical, religious, or other ideological viewpoint;\n\n5. Mandate any applicant for employment provide a diversity,\n\nequity, and inclusion statement or give any applicant for employment\n\npreferential consideration based on the provision of such a\n\ndiversity, equity, and inclusion statement; or\n\n6. Mandate any person to disclose his or her pronouns.\n\nB. After the effective date of this act, institutions of higher\n\neducation within The Oklahoma State System of Higher Education shall\n\ninitiate a review of diversity, equity, and inclusion positions,\n\ndepartments, activities, procedures, and programs and, if deemed\n\nnecessary, restructure or eliminate functions that are not necessary\n\nfor compliance, accreditation, or student or employee support\n\nservices intended to broadly support success.\n\nC. Nothing in this section shall be construed to limit or\n\nprohibit institutions of higher education within The Oklahoma State\n\nSystem of Higher Education, including any agency of the executive\n\nbranch supporting those institutions’ work, from applying for a\n\ngrant or complying with the accreditation requirements of an\n\naccrediting or licensing agency including, but not limited to,\n\nsubmitting to the grantor or accreditation agency a statement that:\n\n1. Highlights the institution’s or agency’s work in supporting:\n\na. first-generation college students,\n\nb. students from low-income families,\n\nc. students with unique abilities, or\n\nd. underserved student populations; or\n\n2. Certifies compliance with applicable anti-discrimination\n\nlaws, rules, and regulations.\n\nD. The provisions of this section shall not be construed to\n\napply to institutions of higher education within The Oklahoma State\n\nSystem of Higher Education with respect to:\n\n1. A policy, practice, procedure, program, class, or activity\n\nrequired for compliance with state or federal laws, rules, or\n\nregulations for obtaining or retaining institutional, academic, or\n\ndiscipline-specific accreditation or licensure;\n\n2. The academic freedom of any individual faculty member to\n\ndirect the instruction within his or her own course;\n\n3. Scholarly research or creative work by an institution of\n\nhigher education’s students, faculty, or other research personnel or\n\nthe dissemination of such research or work;\n\n4. An activity of a student organization registered with or\n\nrecognized by an institution of higher education;\n\n5. Guest speakers or performances on short-term engagements;\n\n6. Academic support, tutoring, and career services and student\n\nsuccess centers, so long as the programming is designed and\n\nimplemented without regard to race, sex, color, national origin, or\n\nethnicity;\n\n7. Data collection; or\n\n8. Access programs for military, veterans, Pell Grant\n\nrecipients, first-generation college students, students from low-\n\nincome families, students with unique abilities, or underserved\nport, tutoring, and career services and student\n\nsuccess centers, so long as the programming is designed and\n\nimplemented without regard to race, sex, color, national origin, or\n\nethnicity;\n\n7. Data collection; or\n\n8. Access programs for military, veterans, Pell Grant\n\nrecipients, first-generation college students, students from low-\n\nincome families, students with unique abilities, or underserved\n\nstudent populations.\n\nE. By July 1, 2026, and each July 1 thereafter, institutions of\n\nhigher education within The Oklahoma State System of Higher\n\nEducation shall electronically submit to the Governor, the President\n\nPro Tempore of the Senate, and the Speaker of the House of\n\nRepresentatives a certificate of compliance with the provisions of\n\nthis section.\n\nF. Nothing in this section shall be construed to prohibit the\n\npromotion of civil discourse, debate, or speech that is protected by\n\nthe First Amendment to the United States Constitution.\n\nG.
