Stat. tit. 70, § 70-3311.4","heading":"Continuing law enforcement training - Inactive status","body":"exemption - Failure to meet training requirements - Suspension of\n\ncertification.\n\nA. Beginning January 1, 2008, and annually thereafter, every\n\nactive full-time peace officer, certified by the Council on Law\n\nEnforcement Education and Training (CLEET) pursuant to Section 3311\n\nof this title, shall attend and complete a minimum of twenty-five\n\n(25) hours of continuing law enforcement training accredited or\n\nprovided by CLEET which shall include a mandatory two (2) hours on\n\nmental health issues. Effective November 1, 2019, CLEET shall\n\nestablish appropriate training resources which shall include the\n\npolicies and protocols for responding to sexual assault calls,\n\nguidelines for the collection and maintenance of sexual assault kits\n\nand continuing education on trauma-informed sexual assault response\n\nand intervention, and shall require all CLEET-certified law\n\nenforcement officers to complete such training on a regular basis to\n\nbe determined by CLEET. CLEET shall promulgate rules to enforce the\n\nprovisions of this section and shall enter into contracts and\n\nagreements for the payment of classroom space, training, food, and\n\nlodging expenses as may be necessary for law enforcement officers\n\nattending such training in accordance with subsection B of Section\n\n3311 of this title. Such training and seminars shall be conducted\n\nin all areas of this state at technology center schools,\n\ninstitutions of higher education, or other approved sites.\n\nB. Beginning January 1, 2017, and annually thereafter, every\n\nactive reserve peace officer, certified by CLEET pursuant to Section\n\n3311 of this title, shall attend and complete a minimum of eight (8)\n\nhours of continuing law enforcement training accredited or provided\n\nby CLEET which shall include a mandatory one (1) hour on mental\n\nhealth issues.\n\nC. Every inactive full-time or reserve peace officer, certified\n\nby CLEET, shall be exempt from these requirements during the\n\ninactive status. Upon reentry to full-time active status, the peace\n\nofficer shall be required to comply with subsection A of this\n\nsection. If a full-time certified peace officer has been inactive\n\nfor five (5) or more years, the officer must complete refresher\n\ntraining as prescribed by CLEET and which shall include a minimum of\n\nfour (4) hours of mental health education and training, within one\n\n(1) year of employment. Upon reentry to active reserve status, the\n\npeace officer shall be required to comply with subsection B of this\n\nsection. If a certified reserve officer has been inactive for five\n\n(5) or more years, the certified reserve officer shall complete a\n\nlegal update as prescribed by CLEET. The Director of CLEET may\n\nwaive these requirements based on review of all records of\n\nemployment and training.\n\nD. Every tribal officer who is commissioned by an Oklahoma law\n\nenforcement agency pursuant to a cross-deputization agreement with\n\nthe State of Oklahoma or any political subdivision of the State of\n\nOklahoma pursuant to the provisions of Section 1221 of Title 74 of\n\nthe Oklahoma Statutes shall comply with the provisions of this\n\nsection.\n\nE. Any active full-time or reserve certified peace officer, or\n\nCLEET-certified cross-deputized tribal officer who fails to meet the\n\nannual training requirements specified in this section, shall be\n\nsubject to having the certification of the peace officer suspended,\n\nafter the peace officer and the employer have been given written\n\nnotice of noncompliance and a reasonable time, as defined by the\n\nCouncil, to comply with the provisions of this section. A peace\n\nofficer shall not be employed in the capacity of a peace officer\n\nduring any period of suspension. The suspension period shall be for\n\na period of time until the officer files a statement attesting to\n\nfull compliance with the provisions of this section. Suspension of\n\npeace officer certification shall be reported to the district\n\nattorney for the jurisdiction in which the officer is employed, the\n\nliability insurance company of the law enforcement agency that\n\nemployed the peace officer, the chief elected official of the\n\ngoverning body of the law enforcement agency and the chief law\n\nenforcement officer of the law enforcement agency. Any officer\n\nwhose certification is suspended pursuant to this section may\n\nrequest a hearing with CLEET. Such hearings shall be governed by\n\nthe Administrative Procedures Act except that the affected officer\n\nhas the burden to show CLEET why CLEET should not have the\n\ncertification of the officer suspended.\n\nF. All certified, active full-time or reserve peace officers\n\nemployed, commissioned or appointed for a period of ninety (90) days\n\nin a calendar year, who become inactive prior to the end of a\n\ncalendar year, are responsible for meeting mandatory continuing\n\neducation requirements as set forth in this section upon return to\n\nactive full-time or reserve peace officer status within sixty (60)\n\ndays of the date of return to employment, commission or appointment.\n\nFailure to complete the mandatory continuing education within sixty\n\n(60) days may result in disciplinary action as set forth in CLEET\n\nRules at OAC 390:2. Full-time or reserve certified peace officers\n\nwho return to active status within the calendar year they become\n\ninactive must complete the annual mandatory continuing education\n\nrequirements outlined in this section within the remaining portion\n\nof the calendar year.\n\nG. Peace officers with full-time certification who worked\n\nduring a calendar year only as a reserve officer are required to\n\ncomplete only the training requirements for reserve certification.\n\nFor purposes of the requirements outlined in subsection F of this\n\nsection, full-time peace officers who worked both in the capacity of\n\na full-time peace officer and reserve officer in a calendar year\n\nmust complete full-time continuing education requirements.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6be6cd94d5071f00a8738884ec3822bccf9795f4f88a78026af591e4af6666c2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-3311.3","next":"us-ok/okla.-stat.-tit.-70-70-3311.5"},"notice":"GroundRules: Original legal text.
