Stat. tit. 70, § 70-3419","heading":"Contributions for agricultural research and extension","body":"The purpose of this section is hereby declared to be that of\n\npermitting and encouraging the agricultural industry of the State of\n\nOklahoma to contribute, on a voluntary basis, to the support and\n\nexpansion of agricultural research on behalf of such industry and on\n\nbehalf of all of the citizens of the state, through the Oklahoma\n\nAgricultural Experiment Station, and to the support and expansion of\n\nthe programs of the Oklahoma Agricultural Extension Division.\n\nTo effectuate the purpose recited in this section, any\n\nagricultural organization, association and corporation in the state,\n\nincluding agricultural cooperatives, and the producers of any\n\nspecific commodity through a referendum of members, is hereby\n\nexpressly authorized and empowered, through appropriate formal\n\naction, to contribute to the support and expansion of agricultural\n\nresearch through the Oklahoma Agricultural Experiment Station, and\n\nto the support and expansion of the programs of the Oklahoma\n\nAgricultural Extension Division, in either of the following ways:\n\n(1) Through direct donation or dedication of money, lands or\n\nother things of value from the assets of the organization,\n\nassociation or corporation.\n\n(2) Through the assessment and collection of an agricultural\n\nresearch fee upon sales of the agricultural products of the members\n\nof any such organization, association, or corporation, or the\n\nproducers of any specific commodity through a referendum of members,\n\nto be fixed in an amount, and collected at the time and in the\n\nmanner specified in a formal order or resolution duly passed and\n\nadopted by any such organization, association or corporation, or the\n\nproducers of any specific commodity through a referendum of members.\n\nAny monies made available under the provisions of this section shall\n\nbe deposited in the State Treasury to the credit of the Board of\n\nRegents for the Oklahoma Agricultural and Mechanical Colleges, kept\n\nin a separate fund, and used solely for the purposes stated in this\n\nsection. The Board of Regents for the Oklahoma Agricultural and\n\nMechanical Colleges shall allocate said funds between the Oklahoma\n\nAgricultural Experiment Station and the Oklahoma Agricultural\n\nExtension Division in a manner, according to the judgment of said\n\nBoard, which will best effectuate the purposes of this section.\n\nProvided, however, that any organization, association or\n\ncorporation, or the producers of any specific commodity through a\n\nreferendum of members, as defined in this section, may designate the\n\nuse to be made of the money, real property or other things of value\n\nwhich it may dedicate for the purposes of the section, not in\n\nconflict with law.\n\nThe State Treasurer is hereby directed and authorized to issue\n\nwarrants upon the State Treasury against the funds made available\n\nunder the terms of this section, for such amounts as he may from\n\ntime to time find to be due upon audited itemized estimates and\n\nclaims which bear the approval of the officials designated by the\n\nBoard of Regents for the Oklahoma Agricultural and Mechanical\n\nColleges for such purpose.\n\nSaid Board of Regents may authorize the expenditure of the funds\n\nmade available by the terms of this section for any purpose which it\n\ndeems necessary or convenient to effectuate the purpose of the\n\nsection, including the acquisition of lands or capital improvements,\n\nexcept where such funds are limited by the terms of the grant, as\n\nhereinabove provided.\n\nAll monies collected under the terms of this section and\n\ndeposited in the State Treasury, as aforesaid, shall constitute a\n\ncontinuing fund, shall not be subject to fiscal limitations, and the\n\nunexpended balances shall at all times be available for expenditure\n\nfor the purposes, and in the manner and form, provided in this\n\nsection. All sums which may become available under the terms of\n\nthis section shall be in addition to, and not in substitution for,\neposited in the State Treasury, as aforesaid, shall constitute a\n\ncontinuing fund, shall not be subject to fiscal limitations, and the\n\nunexpended balances shall at all times be available for expenditure\n\nfor the purposes, and in the manner and form, provided in this\n\nsection.
