Stat. tit. 70, § 70-3903","heading":"State System of Higher Education - Allocations -","body":"Allotments - Accounting classification - Petty cash funds - Expenses\n\nof Boards - Educational and general income.\n\n(a) The Oklahoma State System of Higher Education shall operate\n\nan allotment system similar to the procedure set out in the Oklahoma\n\nState Finance Act, Section 34 et seq. of Title 62 of the Oklahoma\n\nStatutes, for other agencies of the state except that the State\n\nRegents shall be substituted for the Director of the Office of\n\nManagement and Enterprise Services in connection with approving\n\nallotment requests of the constituent institutions and agencies\n\ncomprising the State System. The account classification for the\n\nState System shall conform as nearly as possible with the\n\nclassification of accounts recommended by the publications of the\n\nNational Association of College and University Business Officers.\n\nThe State Regents shall allocate to each institution and agency in\n\nthe State System, from the consolidated or lump-sum appropriation\n\nmade by the Legislature, an amount sufficient to meet the needs and\n\nfunctions of the institution or agency for the entire year. Upon\n\nsuch allocation, monies appropriated for educational and general\n\npurposes shall be transferred to the Educational and General\n\nOperations Revolving Fund of the institution or agency and monies\n\nappropriated for capital improvement purposes shall be transferred\n\nto the Capital Improvement Revolving Fund of the institution or\n\nagency. The amount allocated to an institution or agency for each\n\nfiscal year shall be made in a lump sum without regard to uniform\n\nbudget or accounting classifications, but shall not be available for\n\nexpenditure until subsequently allotted by the State Regents.\n\n(b) The State Regents, with the approval of the Director of the\n\nOffice of Management and Enterprise Services, may allot money to any\n\nsuch institution or agency to establish and operate a petty cash\n\nfund at the institution or agency; said fund shall only be\n\nreimbursed upon the filing of claims showing the purposes for which\n\nthe money was expended. No single expenditure from any petty cash\n\nfund so established and operated shall exceed Five Hundred Dollars\n\n($500.00). Splitting of invoices for the purpose of avoiding this\n\nlimitation is prohibited. Except for payments to sports officials,\n\nresearch participants, refunds to students, competition judges, and\n\ntemporary farm crews employed at Oklahoma Agricultural Experiment\n\nStations, expenditures from such fund for personal services, travel\n\nreimbursement, or professional services are prohibited. Further,\n\nthe exemption for payments to sports officials and refunds to\n\nstudents is limited to only those institutions which have previously\n\nbeen authorized to participate in both the \"Alternate Claims\n\nProcessing\", by the Director of the Office of Management and\n\nEnterprise Services, and \"Remote Warrant Printing\", by the State\n\nTreasurer. The Oklahoma State Regents for Higher Education shall\n\npublish uniform guidelines applicable to all institutions of higher\n\neducation for expenditures from petty cash funds, which shall be\n\nstrictly adhered to.\nized to participate in both the \"Alternate Claims\n\nProcessing\", by the Director of the Office of Management and\n\nEnterprise Services, and \"Remote Warrant Printing\", by the State\n\nTreasurer. The Oklahoma State Regents for Higher Education shall\n\npublish uniform guidelines applicable to all institutions of higher\n\neducation for expenditures from petty cash funds, which shall be\n\nstrictly adhered to.\n\n(c) Governing boards of control are integral parts of\n\ninstitutions under their respective jurisdiction; therefore, the\n\nexpenses of boards in carrying out their respective duties shall be\n\npaid from the operating budgets of the institutions and other budget\n\nagencies under their jurisdiction. In cases where a board is the\n\ngoverning board for two or more institutions and/or other budget\n\nagencies, the board shall prorate its operating expenses among the\n\ninstitutions and/or other budget agencies so governed. Prior to the\n\nbeginning of the fiscal year, each board shall prepare a budget,\n\nsetting out in detail its necessary expenses for the entire fiscal\n\nyear and shall, not later than July 1, file a copy of its budget\n\nwith the President Pro Tempore of the Senate, the Speaker of the\n\nHouse of Representatives, the Director of the Office of Management\n\nand Enterprise Services and the Legislative Service Bureau. Said\n\nbudget shall include all full-time-equivalent positions in each\n\nactivity or division and an itemization of all sources of income\n\nused for operations and programs. Each board shall revise its\n\nbudget, if necessary, and provide said revisions to the President\n\nPro Tempore of the Senate, the Speaker of the House of\n\nRepresentatives, the Director of the Office of Management and\n\nEnterprise Services, and the Legislative Service Bureau not later\n\nthan January 1 of each year. In cases where a board has\n\njurisdiction over two or more institutions or budget agencies, it\n\nshall, not later than July 1, notify the President of each\n\ninstitution as to the amount of its pro rata share of the board's\n\nexpense budget that will be assessed against the institution and/or\n\nother budget agency during the fiscal year.\n\n(d) Prior to the beginning of the fiscal year, the coordinating\n\nboard of the Oklahoma State Regents for Higher Education shall\n\nprepare a budget setting out in detail its necessary expenses for\n\nthe entire fiscal year, and, not later than July 1, shall file a\n\ncopy of its budget with the Director of the Office of Management and\n\nEnterprise Services and the Legislative Service Bureau. The State\n\nRegents shall allocate the money required to fund its budget prior\n\nto making distribution of appropriated monies to the various\n\ninstitutions of The Oklahoma State System of Higher Education.\n\n(e) The Division of Central Accounting and Reporting shall make\n\ncash allocations of revenue in accordance with Section 23 of Article\n\nX of the Oklahoma Constitution, to each institution and agency,\n\nconsidering the total allocation made by the State Regents from the\n\nlump-sum legislative appropriation as the total appropriation for\n\nthe institution or agency, in lieu of legislative appropriations.\n\nAll income available to an institution or agency for educational and\n\ngeneral purposes, as defined in the uniform budget and accounting\n\nclassifications recommended by the publications of the National\n\nAssociation of College and University Business Officers, and\n\nincluding income defined by law as revolving fund income, shall\n\noperate as a continuing nonfiscal appropriation which may be\n\nexpended for any educational and general purpose for which\n\nappropriated funds may be expended, if allocated and allotted in\n\naccordance with the Oklahoma State Finance Act, as provided in this\n\nsection; provided that no obligation shall be incurred in excess of\n\nthe unencumbered balance of cash on hand.\nas revolving fund income, shall\n\noperate as a continuing nonfiscal appropriation which may be\n\nexpended for any educational and general purpose for which\n\nappropriated funds may be expended, if allocated and allotted in\n\naccordance with the Oklahoma State Finance Act, as provided in this\n\nsection; provided that no obligation shall be incurred in excess of\n\nthe unencumbered balance of cash on hand.\n\n(f) At least thirty (30) days prior to the beginning of each\n\nfiscal year, each of the constituent institutions and agencies shall\n\nfile with the State Regents its request for appropriation allotments\n\nfor each of the purposes for which expenditures are to be made. Such\n\nrequests shall be in conformity with the uniform budget or\n\naccounting classifications recommended by the publications of the\n\nNational Association of College and University Business Officers.\n\nEach request for appropriation allotments shall show the amount\n\nrequired to finance each item of the request for the entire year and\n\nfor each quarter or each six-month period within the fiscal year, as\n\nrequired by the Director of the Office of Management and Enterprise\n\nServices. The State Regents, or their designated official or\n\nemployee who has been authorized to approve itemized allotment\n\nrequests, shall consider the allotment requests for the purpose of\n\nmaking a determination that: (1) the current financial requirements\n\nof the institution or agency concerned justify the allotment to be\n\nmade; (2) the accounting classification is sufficient to reflect the\n\npurpose for which expenditures are to be made and that such\n\nclassification is in accordance with the budget classifications\n\nadopted by the Director of the Office of Management and Enterprise\n\nServices and the State Regents, which shall conform as nearly as\n\npossible to the account classification recommended by the\n\npublications of the National Association of College and University\n\nBusiness Officers; and (3) the realization of estimated revenues\n\ndetermined by the Director of the Office of Management and\n\nEnterprise Services is sufficient to allow the commitments to be\n\nmade. In allotting appropriations and other funds, and approving\n\nsubsequent allotments, which may be required by each institution and\n\nagency the State Regents shall follow the same general procedure as\n\nother agencies of the state not under the control of the State\n\nRegents, except as otherwise provided in this section. All forms\n\nand account classifications shall be mutually agreed upon by the\n\nDirector of the Office of Management and Enterprise Services and the\n\nState Regents. The State Regents shall file approved requests of\n\nconstituent institutions and agencies with the Division of Central\n\nAccounting and Reporting. The State Regents and the Director of the\n\nOffice of Management and Enterprise Services shall approve any\n\nrequest from the administrative head of a constituent institution or\n\nagency for amendment of the approved schedule of positions and\n\nsalaries or transfers between items, so long as the currently\n\napproved allotment for such purposes is not exceeded and each such\n\namendment shall be filed with the Director of the Office of\n\nManagement and Enterprise Services, in such detail as he may\n\nrequire, prior to the date on which the first payroll or other\n\ndisbursement affected by such amendments is submitted for payment.\n\nIn the event that the realization of estimated revenues at any time\n\nduring the fiscal year indicates that the total revenue from that\n\nfiscal year to any state fund will be insufficient at the end of the\n\nfiscal year to meet the total appropriations from that fund, the\n\nDirector of the Office of Management and Enterprise Services shall\n\nnotify the State Regents as to the amount of reduction necessary\n\nagainst the consolidated, or lump-sum appropriation, made to the\n\nState Regents.\nyear indicates that the total revenue from that\n\nfiscal year to any state fund will be insufficient at the end of the\n\nfiscal year to meet the total appropriations from that fund, the\n\nDirector of the Office of Management and Enterprise Services shall\n\nnotify the State Regents as to the amount of reduction necessary\n\nagainst the consolidated, or lump-sum appropriation, made to the\n\nState Regents.\n\n(g) The State Regents in making itemized allotments during the\n\nfiscal year, may reserve an amount sufficient to meet a reasonable\n\nfailure of revenue until receipt of notice from the Director of the\n\nOffice of Management and Enterprise Services that the realization of\n\nestimated revenues indicates that the total appropriations may be\n\nallotted for expenditure. Upon receipt of notice from the Director\n\nof the Office of Management and Enterprise Services of a necessary\n\nreduction in the consolidated, or lump-sum appropriation, to meet a\n\nfailure in revenue, the State Regents shall immediately take action\n\nto control the approval of subsequent allotment requests sufficient\n\nto make the aggregate reduction in allotments of all constituent\n\ninstitutions under their control equal the amount of reduction\n\nordered against the lump-sum appropriation made by the Legislature.\n\nSuch reductions against the lump-sum appropriation shall not exceed\n\nthe percentage reduction ordered against other agencies of the\n\nstate, in accordance with Section 23 of Article X of the Oklahoma\n\nConstitution.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"78a24f161b106cadaa4749f02fa73d303a83368f10afdb682378c4ad72dd654a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-3902","next":"us-ok/okla.-stat.-tit.-70-70-3904"},"notice":"GroundRules: Original legal text.
