There is hereby created a trust fund to be known as the\n\n“Oklahoma Higher Learning Access Trust Fund”. The Oklahoma State\n\nRegents for Higher Education shall be the trustees of the Trust\n\nFund.\n\nB. The State Regents shall utilize the Trust Fund to implement\n\nthe provisions of Sections 2601 through 2605 of this title and\n\nSections 1 through 3 of this act.\n\nC. The Trust Fund principal shall consist of monies the\n\nLegislature appropriates or transfers to the Oklahoma State Regents\n\nfor Higher Education for the Trust Fund and any monies or assets\n\ncontributed to the Trust Fund from any other source, public or\n\nprivate. All monies accruing to the credit of the fund are hereby\n\nappropriated and may be budgeted and expended by the State Regents.\n\nExpenditures from the fund shall be made upon warrants issued by the\n\nState Treasurer against claims filed as prescribed by law with the\n\nDirector of the Office of Management and Enterprise Services for\n\napproval and payment.\n\nD. Notwithstanding other provisions of law, income and\n\ninvestment return on Trust Fund principal shall accrue to the Trust\n\nFund for use as provided by authorization of the trustees for the\n\npurposes provided in Sections 2601 through 2605 of this title and\n\nSections 1 through 3 of this act. The State Regents may also\n\nutilize the Trust Fund principal for the purposes provided in\n\nSections 2601 through 2605 of this title and Sections 1 through 3 of\n\nthis act. Except as otherwise provided by law, no such income or\n\ninvestment return or principal shall be used for administrative\n\nexpenses; expenses incurred by the State Regents in the\n\nadministration of the Trust Fund and of the Oklahoma Higher Learning\n\nAccess Program established by the Oklahoma Higher Learning Access\n\nAct and the Oklahoma Access and Achievement Program established by\n\nthe Oklahoma Access and Achievement Act shall be paid from monies\n\nappropriated to the State Regents coordinating board for their\n\ngeneral operating budget.\n\nE. The State Regents shall adopt rules for accomplishing\n\ntransfer of funds from the Oklahoma Higher Learning Access Trust\n\nFund to the appropriate institutional Educational and General\n\nOperations Revolving Funds, as provided in Section 3901 of this\n\ntitle, to private institutions, and to the appropriate technology\n\ncenter school district to cover general enrollment fees or tuition\n\nfor eligible students pursuant to the Oklahoma Higher Learning\n\nAccess Act and the Oklahoma Access and Achievement Act. Allocations\n\nfrom the Trust Fund may be made only for the purpose of covering the\n\ngeneral enrollment fees or tuition of eligible students.
