Nothing in this act shall be construed to:\n\n1. Give a designated beneficiary any rights or legal interest\n\nwith respect to an account unless the designated beneficiary is the\n\naccount owner;\n\n2. Guarantee that a designated beneficiary will be admitted to\n\na higher education institution or be allowed to continue enrollment\n\nat or graduate from a higher education institution located in this\n\nstate after admission;\n\n3. Establish state residency for a person merely because the\n\nperson is a designated beneficiary; or\n\n4. Guarantee that amounts saved pursuant to the program will be\n\nsufficient to cover the qualified higher education expenses of a\n\ndesignated beneficiary.\n\nB. Nothing in this act establishes any obligation of this state\n\nor any agency or instrumentality of this state to guarantee for the\n\nbenefit of any account owner, contributor to an account or\n\ndesignated beneficiary any of the following:\n\n1. The return of any amounts contributed to an account;\n\n2. The rate of interest or other return on any account;\n\n3. The payment of interest or other return on any account; or\n\n4. Tuition rates or the cost of related higher education\n\nexpenditures.\n\nC.
