Stat. tit. 70, § 70-4103","heading":"Accreditation for private and out-of-state public degree-","body":"granting institutions.\n\nA. As used in this section:\n\n1. “Degree-granting institution” means an institution that\n\noffers education leading to an associate’s degree or higher;\n\n2. “Non-degree-granting activity” means offering education or\n\ntraining that does not lead to an associate’s degree or higher; and\n\n3. “State authorization reciprocity agreement” means an\n\nagreement among states, districts, and territories that establishes\n\ncomparable standards for providing distance education from their\n\npostsecondary educational institutions to out-of-state students.\n\nB. All private and out-of-state public degree-granting\n\ninstitutions shall be accredited by an accrediting agency which is\n\nrecognized by the Secretary of the United States Department of\n\nEducation as a reliable authority as to the quality of education or\n\ntraining offered by institutions of higher education for the\n\npurposes of the Higher Education Act of 1965, as amended.\n\nAdditionally, for the purposes of consumer protection and to\n\nmaintain financial eligibility for Title IV funding as described in\n\n34 CFR Part 600, institutions shall be authorized according to the\n\npolicies and procedures established by the Oklahoma State Regents\n\nfor Higher Education. These policies and procedures shall be\n\nlimited to the minimum necessary to ensure that private and out-of-\n\nstate degree-granting institutions that operate in this state by any\n\nmodality meet the same standards of academic quality and fiscal\n\nresponsibility required for institutions of higher education within\n\nThe Oklahoma State System of Higher Education. Beginning with the\n\n2023-2024 academic year, the State Regents shall:\n\n1. Establish and collect fees annually from applicants for\n\nauthorization as necessary to cover the costs of authorization;\n\n2. Require applicants for authorization to submit payment in an\n\namount established by the State Regents into the Tuition Recovery\n\nRevolving Fund created in Section 2 of this act, which shall be used\n\nto offset student tuition losses in the event an authorized\n\ninstitution closes or ceases operations; and\n\n3. Be authorized to deny, not renew, or revoke an institution’s\n\nauthorization if it is found to be in violation of the Oklahoma\n\nstatutes, it fails to meet the minimum authorization standards\n\nestablished by the State Regents, or an accrediting agency or other\n\ngovernment entity revokes its approval, which is material to the\n\ncontinuity of the institution. An institution subject to the\n\nprovisions of this paragraph shall be given reasonable notice and an\n\nopportunity to be heard prior to a decision to deny, not renew, or\n\nrevoke authorization.\n\nC. The following institutions shall be exempt from this\n\nsection:\n\n1. Private institutions participating in the Oklahoma Tuition\n\nEqualization Grant program; and\n\n2. Out-of-state public and private institutions participating\n\nin a state authorization reciprocity agreement that only conduct\n\nactivities in Oklahoma that are acceptable under the terms and\n\nconditions of the state authorization reciprocity agreement.\n\nD. Non-exempt institutions engaged in non-degree granting\n\nactivities, such as offering certificates and diplomas, shall be\n\nsubject to the standards administered by the Oklahoma Board of\n\nPrivate Vocational Schools.\n\nE.
