Stat. tit. 70, § 70-4402","heading":"Application to establish","body":"A community junior college may be established only when\n\napplication therefor has been made to the State Regents by the\n\ngoverning board or boards of one or more cities, counties, towns\n\nand/or school districts having territory in such community, provided\n\nthat existing accredited community junior colleges shall be deemed\n\nto have priority for inclusion in the fiscal budgeting for\n\ninstitutions of higher learning after the effective date of this act\n\nto fulfill the requirements as per Section 1408 of the act.\n\nProvided, that a community junior college may be established in a\n\ncommunity consisting of a geographical area whose boundaries are not\n\nco-extensive with those of one or more cities, counties, towns\n\nand/or school districts, if the population of such area is not less\n\nthan seventy-five thousand (75,000) and the net assessed valuation\n\nin such area is not less than Seventy-five Million Dollars\n\n($75,000,000.00) to be determined by the State Regents, and an\n\napplication therefor is made by petition signed by not less than\n\nfive percent (5%) of the legal voters residing in such area. The\n\napplication shall describe the boundaries of the community in which\n\nthe community junior college will be established and maintained.
