Stat. tit. 70, § 70-4403","heading":"Election - Order - Appointment of governing board -","body":"Annexation of territory.\n\n(a) If, after considering any such application, the State\n\nRegents determine as result of a survey that there is a need for a\n\njunior college in the community and that a junior college meeting\n\nthe criteria and standards fixed by the State Regents can be\n\nmaintained in the community, they shall issue a proclamation calling\n\nan election to be held in the community, to allow legal voters\n\nresiding in the community to vote on the question of whether a\n\njunior college shall be established and maintained in the community.\n\nThe State Election Board shall cause such election to be held in the\n\nsame manner as elections on state questions and shall certify the\n\nresults to the State Regents; and if a majority of the legal voters\n\nresiding in the community, voting on the question, shall have voted\n\nin favor of establishing and maintaining the proposed junior\n\ncollege, the State Regents shall issue an order authorizing the\n\njunior college, designating the name by which it shall be known and\n\ndescribing the boundaries of the community in which the junior\n\ncollege will be established and maintained as set forth in the\n\napplication. Thereupon the Governor shall appoint four members of\n\nthe governing board of the junior college hereinafter provided for,\n\nby and with the advice and consent of the State Senate, such\n\nappointments to be to Position No. 1, Position No. 2, Position No.\n\n3, and Position No. 4, respectively, which four members so appointed\n\nby the Governor shall appoint three other members of the governing\n\nboard, to Position No. 5, Position No. 6, and Position No. 7,\n\nrespectively.\n\n(b) The territory comprising a county, municipality or school\n\ndistrict, or any part thereof, may, upon petition of the governing\n\nboard of the county, municipality or school district, or upon\n\npetition of not less than ten percent (10%) of the legal voters\n\nresiding therein, be annexed to an adjoining community or school\n\ndistrict maintaining or authorized to maintain a community junior\n\ncollege, if (1) the State Regents determine that the annexation is\n\nfeasible, and (2) the annexation is approved by the legal voters in\n\nthe territory proposed to be annexed, as hereinafter provided. The\n\npetition shall be filed with the State Regents, which shall\n\nthereupon cause a study to be made as to the feasibility of the\n\nproposed annexation, and if the State Regents determine that it is\n\nfeasible, they shall issue a proclamation calling an election to be\n\nheld in such territory, to allow legal voters in the territory to\n\nvote on the question of whether the territory shall be annexed to\n\nsuch community or school district maintaining or authorized to\n\nmaintain a community junior college. The State Election Board shall\n\ncause such election to be held in the same manner as elections on\n\nstate questions, and certify the results to the State Regents; and\n\nif a majority of the legal voters residing in such territory, voting\n\non the question, shall have voted in favor of annexing the territory\n\nto such community or school district, the State Regents shall issue\n\nan order annexing the territory to such community or school district\n\nmaintaining or authorized to maintain a community junior college,\n\nand give notice thereof to the board of trustees of the college.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"79cc5082670c374e3f1a7e24d6f0be8ebd4cff4d4032c1c458a32c00f67a521e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-4402","next":"us-ok/okla.-stat.-tit.-70-70-4404"},"notice":"GroundRules: Original legal text.
