Except as otherwise provided in this section, no person may\n\nbe employed or put under contract by a school district if that\n\nperson is related to a member of the board of education of that\n\nschool district within the second degree of consanguinity or\n\naffinity. A teacher or employee already under contract to or\n\notherwise employed by the school district at the time the\n\nrelationship is established may continue in said employment. Except\n\nas otherwise provided, a board member already serving at the time\n\nthe relationship is established may serve out the term for which the\n\nmember was elected but shall not be eligible to be a candidate for\n\nor serve successive terms of office for which the member may be\n\nelected.\n\nB. The provisions of this section shall not prevent a board\n\nmember from serving successive terms of office if otherwise eligible\n\nunder the provision of Section 5-113 of this title. No member of\n\nthe board of education who has resigned from the board before the\n\nterm of the person has expired may be reappointed to the board to\n\ncomplete the remainder of the term if a teacher or employee related\n\nto the resigned member of the board within the second degree of\n\nconsanguinity or affinity was put under contract or otherwise\n\nemployed by the school district after the board member resigned.\n\nC. The provisions of this section shall not prevent a person\n\nwho is related to a member of the board of education within the\n\nsecond degree of consanguinity or affinity from being employed by\n\nthe school district as a substitute teacher pursuant to the\n\nprovisions of Section 6-105 of this title or as a temporary\n\nsubstitute support employee if the school district has an Average\n\nDaily Membership (ADM) of less than five thousand (5,000).\n\nD. The provisions of this section shall not prevent a person\n\nwho is related to a member of the board of education within the\n\nsecond degree of consanguinity or affinity from being employed by\n\nthe school district if the school district has an Average Daily\n\nMembership (ADM) of less than four hundred (400) and the board of\n\neducation has adopted a policy providing for such employment.\n\nE. Any member of a board of education who is related to a\n\nteacher or other employee of the district within the second degree\n\nof consanguinity or affinity shall not attend or participate in any\n\nregular or executive session of the board held to consider any\n\npersonnel matter or litigation relating to said teacher or employee.\n\nThe member may vote on collective bargaining agreements or the\n\nrenewal of contracts as a group if the vote is necessary to form a\n\nquorum of the board of education members. If more than one member\n\nof the board of education is related to a teacher or employee, only\n\nthe minimum number of those members which is necessary to form a\n\nquorum shall be allowed to vote. Each board of education so\n\naffected shall adopt a written policy establishing procedures on\n\nwhen such a member may vote on the renewal of contracts or\n\ncollective bargaining agreements.\n\nF.
