Stat. tit. 70, § 70-5-126","heading":"Refusal, failure or neglect of board - Elector may","body":"institute action.\n\nUpon refusal, failure or neglect of the board of education of\n\nany school district, after written demand made upon them by ten\n\nschool district electors of such school district, or by the State\n\nBoard of Education, either to return the money or to institute and\n\ndiligently prosecute the proper proceedings at law or in equity for\n\nthe recovery of any money or property belonging to such district,\n\npaid out or transferred by any officer thereof, in pursuance of any\n\nunauthorized, unlawful, fraudulent or void contract, made or\n\nattempted to be made by the board of education of any such school\n\ndistrict, or for the penalty provided in Section 5-125 of this\n\ntitle, any school district elector of the school district affected\n\nby such payment or transfer, may, in the name of the State of\n\nOklahoma as plaintiff, institute and maintain any proper action at\n\nlaw or in equity which the board of education of the school district\n\nmight institute and maintain, for the recovery of such property or\n\nfor said penalty, for the benefit of the district, and any judgment\n\nthus obtained shall provide for payment of attorney fees and court\n\ncosts to the prevailing party.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9cdd7bd9566a7edfe79ccea5d9ecbe4116be39e3840d77e865a3501ea52ba84d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-5-125","next":"us-ok/okla.-stat.-tit.-70-70-5-127.1"},"notice":"GroundRules: Original legal text.
