Stat. tit. 70, § 70-5-132","heading":"Students of legal age - Completion of twelfth grade -","body":"Attendance at adult high school completion program.\n\nA. Any person lawfully present in the United States and who is\n\nof legal age and a resident of this state, over the age of twenty-\n\none (21) and under the age of thirty (30), and who has not completed\n\nthe twelfth grade in school shall be given the same educational\n\nprivileges and opportunities provided by law for children over the\n\nage of five (5) and under the age of twenty-one (21), upon\n\nsubmitting to the board of education of the school district in which\n\nthe person resides, or the board's designee, evidence satisfactory\n\nto that board showing that during the time before he or she was age\n\ntwenty-one (21) he or she was unable to attend school for a definite\n\nperiod or periods of time, by reason whereof it was impossible for\n\nhim or her to complete the twelfth grade before reaching the age of\n\ntwenty-one (21). Provided further, the pupil shall be counted in\n\nthe average daily attendance of the district where he or she attends\n\nschool during the period of time provided for in this section for\n\nthe purpose of calculating State Aid for the district. Provided\n\nthat, beginning in the 2025-2026 school year, persons applying for\n\nand approved to attend school in accordance with the provisions of\n\nthis subsection shall only be eligible if such district offers a\n\nfull-time virtual education program and such persons only utilize\n\nthe full-time virtual education program option for the completion of\n\ntheir high school education.\n\nB. Any resident of the state who is age nineteen (19) or older,\n\nwho is not enrolled in any high school program, and who has not\n\ncompleted the twelfth grade may attend any adult high school\n\ncompletion program which is established by a school district and\n\napproved by the State Board of Career and Technology Education if\n\nsuch attendance has the approval of the district offering the\n\nprogram. Such attendance shall not be counted in the average daily\n\nattendance of the district unless the Legislature appropriates\n\nmonies for adult high school completion programs. Such attendance\n\nshall not be counted to meet minimum numbers for accreditation of\n\nthe school district involved, and such students shall not attend\n\nclasses which are a part of the normal class structure of the\n\ndistrict.\n\nC.
