In addition to incentive pay plans authorized pursuant to\n\nSection 4 of this act, the State Board of Education shall develop\n\nnot fewer than five different model incentive pay plans and shall\n\ndistribute information about each plan to every school district\n\nboard of education. No plan developed by the Board or implemented\n\nby a school district board of education shall permit payment in any\n\none (1) year of incentives to any one teacher amounting to more than\n\nfifty percent (50%) of the regular salary of the teacher, exclusive\n\nof fringe benefits or extra duty pay. Any incentive pay award shall\n\nbe an annual award and shall not be a part of a continuing contract\n\nof a teacher. Any incentive pay awards received shall be excluded\n\nfrom the compensation of a teacher for purposes of calculating\n\nretirement pursuant to the Teachers' Retirement System of Oklahoma\n\nand shall not be subject to taxes levied by the Federal Insurance\n\nContributions Act (F.I.C.A.), to the extent an exemption is provided\n\nby federal law.\n\nB. A school district board of education may adopt an\n\nacademically based, district incentive pay plan for the classroom\n\nteachers in the district. The district may adopt any incentive pay\n\nplan consistent with the requirements of this section, which may\n\ninclude any incentive pay plan developed by the State Board of\n\nEducation pursuant to this section. The school district board of\n\neducation shall appoint an advisory committee consisting of\n\nteachers, parents, business persons or farmers and other local\n\ncitizens to advise the board in formulating an incentive pay plan.\n\nPrior to the adoption of a plan, the board of education shall place\n\nthe plan on the school board agenda for public comment and shall\n\nsubmit the plan to the State Board of Education for final approval\n\non or before March 1 prior to implementation of the plan during the\n\nsucceeding school year. The board of education shall comply with\n\nthe provisions of this subsection for any year a plan is to be\n\nmodified.\n\nC. A school district shall be required to adopt and implement\n\nan academically based, district incentive pay plan for any school\n\nyear following the receipt by the school district board of\n\neducation, of a petition signed by twenty percent (20%) of the\n\nclassroom teachers employed in the district which calls for the\n\nadoption of an incentive pay plan for the district.\n\nD. Student test scores shall not be the sole criterion for\n\nallocation of incentive pay under any plan developed or approved by\n\nthe Board.\n\nE. For the purposes of this section only, \"classroom teacher\"\n\nshall mean any employee who holds certification and assignment\n\noutside the classification of administrator.\n\nF. The State Board of Education shall promulgate rules\n\nnecessary for the effective implementation and administration of\n\nthis section.\n\nG. Each school district board of education shall provide for a\n\nlocal evaluation committee which shall advise the board on which\n\nteachers are to receive incentive pay awards and the amount of each\n\nincentive pay award according to the plan.\n\nH.
