In addition to incentive pay plans authorized pursuant\n\nto Section 5-141.2 of this title, beginning with the 2012-13 school\n\nyear, a school district may implement an incentive pay plan that\n\nrewards teachers who are increasing student and school growth in\n\nachievement.\n\n2. Teacher performance shall be measured using the Oklahoma\n\nTeacher and Leader Effectiveness Evaluation System (TLE) as set\n\nforth in Section 6-101.16 of this title.\n\n3. Individual teacher incentive pay awards shall be based upon:\n\na. achieving either a \"superior\" or \"highly effective\"\n\nrating under the TLE, and\n\nb. grade level, subject area, or school level performance\n\nsuccess.\n\nB. 1. Beginning with the 2012-13 school year, a school\n\ndistrict may implement an incentive pay plan as authorized pursuant\n\nto this section.\n\n2. For purposes of this section, \"leader\" means a principal,\n\nassistant principal or any other school administrator who is\n\nresponsible for supervising classroom teachers.\n\n3. School leader effectiveness shall be measured using the\n\nOklahoma Teacher and Leader Effectiveness Evaluation System (TLE) as\n\nset forth in Section 6-101.16 of this title.\n\n4. Individual school leader incentive pay awards shall be based\n\nupon:\n\na. achieving either a \"superior\" or \"highly effective\"\n\nrating under the TLE, and\n\nb. grade level, subject area, or school level performance\n\nsuccess.\n\nC. Incentive pay plans implemented pursuant to subsections A\n\nand B of this section shall be developed through a collaborative\n\nplanning process involving stakeholders, including teachers and\n\nschool leaders.\n\nD. In addition to individual teacher and leader incentive pay\n\nplans, as authorized pursuant to this section, districts may develop\n\nand implement incentive pay systems for:\n\n1. Teaching in critical shortage subject areas including, but\n\nnot limited to, foreign language;\n\n2. Teachers and leaders who work in schools identified as in\n\nneed of improvement as determined by the State Board of Education;\n\n3. Teaching in the subject areas of Science, Technology,\n\nEngineering, and Math (STEM); or\n\n4. Teachers and leaders who work in schools or school districts\n\ndesignated by the State Board of Education as hard-to-staff.\n\nE. 1. Prior to implementation of any incentive pay plan\n\ndeveloped pursuant to this section, the school district board of\n\neducation shall place the plan on the agenda for public comment at a\n\nmeeting of the district board of education.\n\n2. After approval of the incentive pay plan, the school\n\ndistrict board of education shall submit the plan to the State Board\n\nof Education for final approval. Within sixty (60) days of receipt\n\nof the plan, the State Board shall review and approve or reject the\n\nplan. If it is determined that the plan meets the requirements of\n\nthis section, the State Board shall approve the plan. If the plan\n\ndoes not meet the requirements of this section, the State Board\n\nshall reject the plan and provide written notification to the school\n\ndistrict board of education along with the grounds for rejection.\n\n3. The district board of education shall comply with the\n\nprovisions of this subsection for any year a plan is to be modified.\n\nF. Any incentive pay award shall be an annual award and shall\n\nnot be a part of a continuing contract for an employee. Any\n\nincentive pay award to any teacher or leader shall not exceed more\n\nthan fifty percent (50%) of the regular salary of the teacher or\n\nleader, exclusive of fringe benefits or extra duty pay. Any\n\nincentive pay awards received shall be excluded from compensation\n\nfor purposes of calculating retirement pursuant to the Teachers'\n\nRetirement System of Oklahoma and shall not be subject to taxes\n\nlevied by the Federal Insurance Contributions Act (F.I.C.A.), to the\n\nextent such exemption is provided by federal law.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2966b0622bb903f81fcb793438c2fd8d3021363c16b8df992064dc048da80ab5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-5-141.3","next":"us-ok/okla.-stat.-tit.-70-70-5-142"},"notice":"GroundRules: Original legal text.
