Any school employee, as defined by subsection A of Section\n\n650.7 of Title 21 of the Oklahoma Statutes, upon whom an assault,\n\nbattery, assault and battery, or aggravated battery or aggravated\n\nassault and battery is committed while in the performance of any\n\nduties as a school employee shall notify either the superintendent,\n\nbuilding administrator, or one member of a Safe School Committee of\n\nthe school district employing the school employee. The building\n\nadministrator or member of the Safe School Committee shall notify\n\nthe superintendent of the assault, battery, assault and battery,\n\naggravated battery or aggravated assault and battery.\n\nB. The superintendent shall notify the State Department of\n\nEducation of all incidents described in subsection A of this section\n\nfor the previous year on July 1 of each year. The report shall\n\ninclude a description of the battery or assault and battery, and the\n\nfinal disposition of each incident.\n\nC. The State Department of Education shall submit a report to\n\nthe President Pro Tempore of the Senate, the Speaker of the House of\n\nRepresentatives, and the Governor on December 1 of each year.\n\nD. For purposes of this section, “assault” shall be defined by\n\nSection 641 of Title 21 of the Oklahoma Statutes, “battery” shall be\n\ndefined by Section 642 of Title 21 of the Oklahoma Statutes, and\n\n“aggravated assault and battery” shall be defined by Section 646 of\n\nTitle 21 of the Oklahoma Statutes.\n\nE. No school employee shall be subject to any civil liability\n\nfor any statement, report, or action taken in reporting or assisting\n\nin reporting a battery or assault and battery which is committed\n\nupon the school employee while in the performance of any duties\n\nunless such report or assistance was made in bad faith or with\n\nmalicious purpose.\n\nF.
