As used in this section only:\n\n1. \"Donate\" means to give without requiring anything of\n\nmonetary value from the recipient; and\n\n2. \"Nonprofit organization\" means an incorporated or\n\nunincorporated organization that has been established and is\n\noperating for religious, charitable or educational purposes and that\n\ndoes not distribute any of its income to its members, directors or\n\nofficers.\n\nB. A school district may allow a school site to elect to donate\n\nfood to a nonprofit organization through an official oncampus\n\nnonprofit representative or designee who is directly affiliated with\n\nthe school site such as a teacher, counselor or Parent-Teacher\n\nAssociation (PTA) member, and the donated food may be received,\n\nstored and redistributed at the school site at any time. Food\n\ndonated by the school site may include surplus food from breakfast,\n\nlunch, snack and dinner meals served at the campus cafeteria subject\n\nto any applicable local, state and federal requirements. Examples\n\nof eligible leftover food include packaged/unpackaged unserved food;\n\nserved/unserved food with packaging in good condition; whole, uncut\n\nproduce; wrapped raw produce; and/or fruit which will be peeled such\n\nas bananas or oranges.\n\nC. Food donated under this section to a nonprofit organization\n\nmay be redistributed on the school site. School employees may\n\nassist in preparing and distributing the food as volunteers for the\n\nnonprofit organization.\n\nD. A school district that makes or a nonprofit organization\n\nthat receives a good-faith donation of food which is at the time of\n\ndonation fit for human consumption shall not be liable for damages\n\nin any civil suit or subject to criminal prosecution for any injury\n\nresulting from the nature, age, condition or packaging of the\n\ndonated food, unless the injury or death is a direct result of gross\n\nnegligence, recklessness or intentional misconduct of the school\n\ndistrict or nonprofit organization.\n\nE.
