Stat. tit. 70, § 70-6-101.10","heading":"Establishment of written policy of evaluation and","body":"corresponding professional development.\n\nA. Each school district board of education shall maintain and\n\nannually review, following consultation with or involvement of\n\nrepresentatives selected by local teachers, a written policy of\n\nevaluation and corresponding professional development for all\n\nteachers and administrators. In those school districts in which\n\nthere exists a professional negotiations agreement made in\n\naccordance with Section 509.1 et seq. of this title, the procedure\n\nfor evaluating members of the negotiations unit and any standards of\n\nperformance and conduct proposed for adoption beyond those\n\nestablished by the State Board of Education shall be negotiable\n\nitems. Nothing in this section shall be construed to annul, modify\n\nor to preclude the renewal or continuing of any existing agreement\n\nheretofore entered into between any school district and any\n\norganizational representative of its employees. Every policy of\n\nevaluation adopted by a board of education shall:\n\n1. Be based upon a set of minimum criteria developed by the\n\nState Board of Education, which shall be revised and based upon the\n\nOklahoma Teacher and Leader Effectiveness Evaluation System (TLE)\n\ndeveloped by the State Board of Education as provided in Section 6-\n\n101.16 of this title. The revisions to each policy of evaluation\n\nshall be phased in according to the following schedule:\n\na. for the 2014-2015, 2015-2016 and 2016-2017 school\n\nyears, the evaluation rating of teachers and\n\nadministrators shall be based on the qualitative\n\ncomponent of the TLE. For the 2016-2017 school year,\n\nthe State Department of Education shall work with\n\nschool districts to develop individualized programs of\n\nprofessional development as described in subsection B\n\nof this section. However, nothing in this\n\nsubparagraph shall preclude a school district with an\n\naverage daily attendance of more than thirty-five\n\nthousand (35,000) from continuing to use quantitative\n\ncomponents which the district has incorporated at its\n\nown expense prior to the 2015-2016 school year into\n\nits evaluation system of teachers and administrators,\n\nas defined by the district's written policy,\n\nb. for evaluations of teachers and administrators\n\nconducted during the 2017-2018 school year, and each\n\nschool year thereafter, school districts shall\n\nincorporate and put into operation the qualitative\n\ncomponent of the TLE as provided for in subsection B\n\nof Section 6-101.16 of this title into the evaluations\n\nused in all school sites within the district. For the\n\n2017-2018 school year, and each school year\n\nthereafter, teachers and administrators shall receive\n\na district evaluation rating based on the components\n\nof the TLE as set forth in subsection B of Section 6-\n\n101.16 of this title. For the 2017-2018 school year,\n\nschool districts shall incorporate the individualized\n\nprograms of professional development as described in\n\nsubsection B of this section on a pilot program basis,\n\nand\n\nc. for evaluations of teachers and administrators\n\nconducted during the 2018-2019 school year, and each\n\nschool year thereafter, school districts shall fully\n\nincorporate and put into operation the individualized\n\nprograms of professional development as described in\n\nsubsection B of this section;\n\n2. Be prescribed in writing at the time of adoption and at all\n\ntimes when amendments to the policy are adopted. The original\n\npolicy and all amendments to the policy shall be promptly made\n\navailable to all persons subject to the policy;\n\n3. Provide that all evaluations be made in writing and that\n\nevaluation documents and responses thereto be maintained in a\n\npersonnel file for each evaluated person;\n\n4. Provide that every probationary teacher receive formative\n\nfeedback from the evaluation process at least two times per school\n\nyear, once during the fall semester and once during the spring\n\nsemester;\n\n5. Provide that every teacher be evaluated once every year,\nbe made in writing and that\n\nevaluation documents and responses thereto be maintained in a\n\npersonnel file for each evaluated person;\n\n4. Provide that every probationary teacher receive formative\n\nfeedback from the evaluation process at least two times per school\n\nyear, once during the fall semester and once during the spring\n\nsemester;\n\n5. Provide that every teacher be evaluated once every year,\n\nexcept for career teachers receiving a district evaluation rating of\n\n\"superior\" or \"highly effective\" under the TLE who may be evaluated\n\nonce every three (3) years; and\n\n6. Provide that, except for superintendents of independent and\n\nelementary school districts and superintendents of area school\n\ndistricts who shall be evaluated by the school district board of\n\neducation, all certified personnel shall be evaluated by a\n\nprincipal, assistant principal, designee of the principal,\n\nsupervisor, content expert, department chair, peer committee or\n\nother trained persons or groups of persons designated by the school\n\ndistrict board of education.\n\nB. 1. Every policy of professional development adopted by a\n\nschool district board of education shall provide for the development\n\nof a focused and individualized program of professional development\n\nfor the teacher or administrator that is consistent with the\n\nqualitative component of the TLE. The policy of professional\n\ndevelopment shall:\n\na. establish an annual professional growth goal for the\n\nteacher or administrator that is developed by the\n\nteacher or administrator in collaboration with the\n\nevaluator,\n\nb. be tailored to address a specific area or criteria\n\nidentified through the qualitative component of the\n\nTLE,\n\nc. allow the teacher or administrator to actively engage\n\nwith learning practices that are evidence-based,\n\nresearched practices that are correlated with\n\nincreased student achievement, and\n\nd. be supported by resources that are easily available\n\nand supplied by the school district and the State\n\nDepartment of Education.\n\n2. School districts shall monitor compliance with each\n\nindividualized program of professional development implemented\n\npursuant to this subsection. All professional development completed\n\npursuant to an individualized program of professional development\n\nshall count toward the total number of points a teacher or\n\nadministrator is required to complete as established by a school\n\ndistrict board of education pursuant to Section 6-194 of this title.\n\nThe implementation of the individualized program of professional\n\ndevelopment required by this subsection shall not be construed as\n\nincreasing the professional development points requirements.\n\n3. Individualized programs of professional development required\n\nby this subsection may include but are not limited to the following\n\nlearning practices:\n\na. presenter-led workshops,\n\nb. individual or faculty studies of books, scholarly\n\narticles and video productions,\n\nc. peer observations,\n\nd. committee studies to address student achievement\n\nissues,\n\ne. work related to a specific subject area or areas\n\nassociated with obtaining an advanced degree or\n\nprofessional certification,\n\nf. action research projects designed to improve student\n\nachievement, and\n\ng. participation in local, regional or state initiatives\n\nassociated with the development or implementation of\n\ncurriculum standards.\n\nC. All individuals designated by the school district board of\n\neducation to conduct the personnel evaluations shall be required to\n\nparticipate in training conducted by the State Department of\n\nEducation or training provided by the school district using\n\nguidelines and materials developed by the State Department of\n\nEducation prior to conducting evaluations.\n\nD. The State Department of Education shall develop and conduct\n\nworkshops pursuant to statewide criteria which train individuals in\n\nconducting evaluations.\n\nby the State Department of\n\nEducation or training provided by the school district using\n\nguidelines and materials developed by the State Department of\n\nEducation prior to conducting evaluations.\n\nD. The State Department of Education shall develop and conduct\n\nworkshops pursuant to statewide criteria which train individuals in\n\nconducting evaluations.\n\nE. The State Board of Education shall monitor compliance with\n\nthe provisions of this section by school districts.\n\nF. The State Board of Education shall study continued\n\nimplementation of the TLE to produce a system that promotes\n\nreflection and professional growth for teachers and leaders.\n\nG. Refusal by a school district to comply with the provisions\n\nof this section shall be grounds for withholding State Aid funds\n\nuntil compliance occurs.\n\nH.
