Whenever the school district board of education or the\n\nadministration of a school district shall determine that the\n\ndismissal or nonreemployment of a full-time certified administrator\n\nfrom the administrative position within the school district should\n\nbe effected, the administrator shall be entitled to the following\n\ndue process procedures:\n\n1. A statement shall be submitted to the administrator in\n\nwriting prior to the dismissal or nonreemployment which states the\n\nproposed action, lists the reasons for effecting the action, and\n\nnotifies the administrator of his or her right to a hearing before\n\nthe school district board of education prior to the action; and\n\n2. A hearing before the school district board of education\n\nshall be granted upon the request of the administrator prior to the\n\ndismissal or nonreemployment. A request for a hearing shall be\n\nsubmitted to the board of education not later than ten (10) days\n\nafter the administrator has been notified of the proposed action.\n\nB. Failure of the administrator to request a hearing before the\n\nschool district board of education within ten (10) days after\n\nreceiving the written statement shall constitute a waiver of the\n\nright to a hearing. No decision of the board of education\n\nconcerning the dismissal or nonreemployment of a full-time certified\n\nadministrator shall be effective until the administrator has been\n\nafforded due process as specified in this section. The decision of\n\nthe school district board of education concerning the dismissal or\n\nnonreemployment, following the hearing, shall be final.\n\nC. Beginning with the 2017-2018 school year and thereafter, a\n\nprincipal who has received district evaluation ratings of\n\n\"ineffective\" as measured pursuant to the TLE as set forth in\n\nSection 6-101.16 of this title for two (2) consecutive school years\n\nmay be dismissed or not reemployed by the school district, subject\n\nto the due process procedures of this section.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"561ae2f447f06dd64dd182ad54f441b04ae5a915a8f30c0fedb2bbd26f6f2a36","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-6-101.11","next":"us-ok/okla.-stat.-tit.-70-70-6-101.14"},"notice":"GroundRules: Original legal text.
