Subject to the provisions of the Teacher Due Process Act of\n\n1990, a career teacher may be dismissed or not reemployed for:\n\n1. Willful neglect of duty;\n\n2. Repeated negligence in performance of duty;\n\n3. Mental or physical abuse to a child;\n\n4. Knowing and willful failure to report suspected child abuse\n\nor neglect;\n\n5. Incompetency;\n\n6. Instructional ineffectiveness;\n\n7. Unsatisfactory teaching performance;\n\n8. Commission of an act of moral turpitude; or\n\n9. Abandonment of contract.\n\nB. Subject to the provisions of the Teacher Due Process Act of\n\n1990, a probationary teacher may be dismissed or not reemployed for\n\ncause.\n\nC. During the 2017-2018 school year and thereafter:\n\n1. A career teacher who has received a district evaluation\n\nrating of “ineffective” as measured pursuant to the Oklahoma Teacher\n\nand Leader Effectiveness Evaluation System (TLE) for two (2)\n\nconsecutive school years shall be dismissed or not reemployed on the\n\ngrounds of instructional ineffectiveness by the school district,\n\nsubject to the provisions of the Teacher Due Process Act of 1990.\n\nHowever, the superintendent may recommend and the school district\n\nboard of education may approve continued employment of the teacher;\n\nand\n\n2. A career teacher who has received a district evaluation\n\nrating of “needs improvement” or lower as measured pursuant to the\n\nTLE for three (3) consecutive school years may be dismissed or not\n\nreemployed on the grounds of instructional ineffectiveness by the\n\nschool district, subject to the provisions of the Teacher Due\n\nProcess Act of 1990.\n\nD. During the 2017-2018 school year and thereafter:\n\n1. A probationary teacher who has received a district\n\nevaluation rating of “ineffective” as measured pursuant to the TLE\n\nfor two (2) consecutive school years may be dismissed or not\n\nreemployed by the school district subject to the provisions of the\n\nTeacher Due Process Act of 1990; and\n\n2. A probationary teacher who has not attained career teacher\n\nstatus within a four-year period may be dismissed or not reemployed\n\nby the school district, subject to the provisions of the Teacher Due\n\nProcess Act of 1990.\n\nE. A teacher shall be dismissed or not reemployed, unless a\n\npresidential or gubernatorial pardon has been issued, if during the\n\nterm of employment the teacher is convicted in this state, the\n\nUnited States, or another state of:\n\n1. Any sex offense subject to the Sex Offenders Registration\n\nAct in this state or subject to another state’s or the federal sex\n\noffender registration provisions;\n\n2. Knowingly and willfully failing to report suspected abuse or\n\nneglect of a child in violation of Section 1-2-101 of Title 10A of\n\nthe Oklahoma Statutes; or\n\n3. Any felony offense.\n\nF. A teacher may be dismissed, refused employment, or not\n\nreemployed after a finding that such person has engaged in acts that\n\ncould form the basis of criminal charges sufficient to result in the\n\ndenial or revocation of a certificate for a reason set forth in\n\nsubparagraph a or b of paragraph 6 of Section 3-104 of this title.\n\nG. As used in this section, “abandonment of contract” means the\n\nfailure of a teacher to report at the beginning of the contract term\n\nor otherwise perform the duties of a contract of employment when the\n\nteacher has accepted other employment or is performing work for\n\nanother employer that prevents the teacher from fulfilling the\n\nobligations of the contract of employment.\n\nH.
