Stat. tit. 70, § 70-6-101.25","heading":"Recommendation of dismissal or not to reemploy to be","body":"in writing - Basis or grounds.\n\nA. Whenever a superintendent decides to recommend that a\n\nteacher or administrator employed within the school district be\n\ndismissed or not reemployed, the superintendent shall state the\n\nrecommendation in writing, setting forth the basis for the\n\nrecommendation, and shall submit such recommendation to the board of\n\neducation.\n\nIf the teacher subject to such recommendation is a career\n\nteacher, the recommendation shall specify the statutory grounds for\n\nwhich the recommendation is based.\n\nIf the teacher subject to such recommendation is a probationary\n\nteacher, the recommendation shall specify the cause for which the\n\nrecommendation is based.\n\nThe superintendent shall also specify the underlying facts\n\nsupporting the recommendation.\n\nB. 1. If the recommendation includes grounds that could form\n\nthe basis of criminal charges sufficient to result in the denial or\n\nrevocation of a certificate for a reason set forth in subparagraph a\n\nof paragraph 6 of subsection A of Section 3-104 of this title, or if\n\nthe recommendation includes a reason set forth in subparagraph a of\n\nparagraph 6 of subsection A of Section 3-104 of this title and is\n\nbased on an agreement between the teacher or administrator and\n\nschool district to avoid civil litigation or a settlement of a civil\n\naction unless the court orders the terms of such settlement to be\n\nkept confidential, a copy of the recommendation shall also be\n\nforwarded to the State Board of Education when the recommendation is\n\nmade pursuant to the due process procedures provided for in Section\n\n6-101.26 of this title, regardless of whether the teacher or\n\nadministrator resigns before or after a termination recommendation\n\nis made, provided that the resignation occurs while the teacher or\n\nadministrator is under investigation for conduct that could form the\n\nbasis for criminal charges or certificate revocation. A report of\n\nsuch resignation including any investigatory findings to date shall\n\nbe forwarded to the State Board of Education. Failure to forward a\n\ncopy of the recommendation to the State Board of Education shall not\n\nbe the basis for any claim or action against a public school, its\n\nboard of education, employees, agents, or other representatives. If\n\nthe school district forwards a copy of the recommendation to the\n\nState Board of Education, the school district shall\n\ncontemporaneously forward a copy to the teacher or administrator\n\nsubject to such recommendation. The teacher or administrator may\n\nprovide supplementary information to the State Board of Education.\n\n2. If the investigation into the conduct of the teacher or\n\nadministrator concludes without findings to support criminal\n\ncharges, certificate revocation, or termination, the individual’s\n\nreport shall be expunged from State Board of Education records and\n\nwritten notification of the clearance shall be sent to all affected\n\nparties.\n\nC. Only school districts may request a copy of the\n\nrecommendation from the State Board of Education, and only if a\n\nteacher or administrator is being considered for new employment or a\n\nteacher or administrator is currently employed by the requesting\n\nschool district. The State Board of Education shall notify the\n\nteacher or administrator subject to the recommendation if such a\n\nrequest is made and provide the identity of the school district that\n\nmade such request. The teacher or administrator subject to the\n\nrecommendation shall retain the right to provide supplementary\n\ninformation to the State Board of Education to accompany any\n\ndocuments requested. The State Board of Education shall provide the\n\nrequesting school district documents related to the recommendation\n\nas well as any supplementary information provided by the teacher or\n\nadministrator subject to the recommendation, and copies shall be\n\ncontemporaneously forwarded to the teacher or administrator subject\nnformation to the State Board of Education to accompany any\n\ndocuments requested. The State Board of Education shall provide the\n\nrequesting school district documents related to the recommendation\n\nas well as any supplementary information provided by the teacher or\n\nadministrator subject to the recommendation, and copies shall be\n\ncontemporaneously forwarded to the teacher or administrator subject\n\nto the recommendation. Records provided to a requesting school\n\ndistrict pursuant to this subsection shall be kept confidential.\n\nD. Except as provided for in subsection C of this section, the\n\nState Board of Education shall keep recommendations submitted\n\npursuant to subsection B of this section confidential. Records\n\ncreated pursuant to this section shall not be subject to disclosure\n\nunder the Oklahoma Open Records Act.\n\nE. If the State Board of Education or a school district that\n\ngenerated or received documents pursuant to subsection C of this\n\nsection is served a subpoena requesting disclosure of the documents,\n\nthe teacher or administrator subject to the recommendation shall\n\nimmediately be notified and be provided the opportunity to object to\n\nthe subpoena.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"38ac41aded926509acc1dd0fa59d3c9f87963db1aa8ee59cc022798e13cc95c4","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-6-101.24","next":"us-ok/okla.-stat.-tit.-70-70-6-101.26"},"notice":"GroundRules: Original legal text.
