The board of education of each school district in the\n\nstate shall provide for sick leave for all teachers employed in the\n\ndistrict and shall pay such teachers the full amount of their\n\ncontract salaries during any absence from their regular school\n\nduties for a period of time and under such conditions as the board\n\nmay determine, but not less than the minimum benefits hereafter\n\nspecified. Payment for sick leave shall be made on the basis of the\n\ncurrent salary rate then in effect for the teacher receiving the\n\npayment. Unless otherwise provided in Section 6-104.8 of this\n\ntitle, the plan shall provide that a teacher may be absent from his\n\nor her duties due to personal accidental injury, illness or\n\npregnancy, or accidental injury or illness in the immediate family\n\nwithout the loss of salary for not to exceed ten (10) days during\n\neach school year, except that said absence without loss of salary\n\nfor teachers employed on an eleven-month contract shall not exceed\n\neleven (11) days during each school year and for those teachers\n\nemployed on a twelve-month contract shall not exceed twelve (12)\n\ndays during each school year, if said contract is for the work\n\nperiod, and not merely for pay purposes. The right to such leave\n\nshall vest at the beginning of the school year. Each school\n\ndistrict shall provide for all teachers a minimum of three (3) days\n\nfor personal business leave, upon the request of the teacher.\n\nSalary deductions for such leave shall not exceed the salary level\n\nfor substitute teachers. Provided further, that these terms for\n\npersonal business leave shall not negate any locally negotiated\n\nleave policies which exceed the minimum benefits stated above. Each\n\nschool district may provide not more than five (5) days each year\n\nfor emergency leave. Each school district will determine the\n\npurposes for which emergency leave can be used. Those days shall\n\nnot be chargeable to sick leave and will be noncumulative. Unused\n\nsick leave shall be cumulative up to a total of sixty (60) days, and\n\ncumulative sick leave shall be transferable to another school\n\ndistrict or to the Oklahoma School for the Blind or the Oklahoma\n\nSchool for the Deaf where the teacher is employed the next\n\nsucceeding school year, provided that the number of days transferred\n\nshall not exceed the maximum days permitted by the receiving school\n\nand that such transferred days shall be used first in case of\n\nillness and, provided further, that if the receiving school pays\n\nteachers for unused sick leave upon retirement or termination of\n\ncontract, then said payments shall be for only those days\n\naccumulated in the receiving school. The school board of the\n\nsending district shall certify the exact number of days eligible for\n\ntransfer.\n\n2. If a teacher is employed at the Oklahoma School for the\n\nBlind or the Oklahoma School for the Deaf after July 1, 2017, any\n\nunused sick leave up to a total of sixty (60) days that is\n\naccumulated at a school district prior to such date shall be\n\ntransferable.\n\nB. The plan of each school district for sick leave benefits may\n\ninclude other terms and conditions, but shall not provide less sick\n\nleave benefits than those prescribed herein. Hospital and medical\n\nproceeds may not be charged against sick leave benefits, but the\n\nproceeds received by the teacher from any insurance provided by the\n\ndistrict for loss of compensable time may be charged against sick\n\nleave benefits. Provided the board of education may provide all or\n\npart of hospital and medical benefits, and sickness, accident,\n\nhealth and life insurance or any of the aforesaid for any or all of\n\nits employees. On authorization of the teacher, the district may\n\napprove payroll deductions for such teacher's portion of the\n\naforesaid.\n\nC. Each school district shall grant a teacher leave for jury\neave benefits. Provided the board of education may provide all or\n\npart of hospital and medical benefits, and sickness, accident,\n\nhealth and life insurance or any of the aforesaid for any or all of\n\nits employees. On authorization of the teacher, the district may\n\napprove payroll deductions for such teacher's portion of the\n\naforesaid.\n\nC. Each school district shall grant a teacher leave for jury\n\nservice or as a witness subpoenaed in a criminal, civil or juvenile\n\nproceeding and shall pay the teacher during such service the full,\n\ncurrent contract salary. Provided that the district may deduct any\n\ncompensation received for serving as a juror or witness from the\n\nteacher's salary during such service.\n\nD. 1. A school district shall also provide for benefits for\n\npersonnel other than teachers. Benefits for support personnel\n\nemployees shall include provisions for paid sick leave of at least\n\none (1) day per month of employment not to exceed the number of\n\nhours per day for which they are regularly employed cumulative to a\n\ntotal of sixty (60) days and cumulative sick leave shall be\n\ntransferable to another school district where the person is employed\n\nthe next succeeding school year; provided, that the number of days\n\ntransferred shall not exceed the maximum days permitted by the\n\nreceiving district and that such transferred days shall be used\n\nfirst in case of illness up to a maximum of ten (10) transferred\n\ndays per school year unless the local board of education authorizes\n\nthe use of additional transferred days during the school year in an\n\namount set by the board and, provided further, that if the receiving\n\ndistrict pays such person for unused sick leave upon retirement or\n\ntermination of employment, then said payments shall be for only\n\nthose days accumulated in the receiving district. The school board\n\nof the sending district shall certify the exact number of days\n\neligible for transfer. Each school district shall provide for all\n\nsupport employees, a minimum of three (3) days for personal business\n\nleave, upon the request of the support employee. Salary deductions\n\nfor personal business leave shall not exceed an amount necessary to\n\ncover the costs of services provided to the district by the support\n\nemployee and shall not exceed the salary of the support employee.\n\nThe terms for personal business leave provided by this subsection\n\nshall not negate any locally negotiated leave policies which exceed\n\nthe minimum benefits stated above. Payment for such leave shall be\n\ncalculated with regard to the definition of \"support employee\"\n\nprovided by Section 6-101.40 of this title. Provided that such\n\nbenefits shall not exceed those authorized for teachers hereunder.\n\n2.
