The board of education of each school district may establish\n\na leave sharing program for all district employees. The program\n\nshall permit district employees to donate sick leave to a fellow\n\ndistrict employee who is pregnant or recovering from childbirth or\n\nwho is suffering from or has a relative or household member\n\nsuffering from an extraordinary or severe illness, injury,\n\nimpairment, or physical or mental condition which has caused or is\n\nlikely to cause the employee to take leave without pay or to\n\nterminate employment.\n\nB. As used in this section:\n\n1. “Relative of the employee” means a spouse, child, stepchild,\n\ngrandchild, grandparent, stepparent, or parent of the employee;\n\n2. “Household members” means those persons who reside in the\n\nsame home, who have reciprocal duties to and do provide financial\n\nsupport for one another. This term shall include foster children\n\nand legal wards even if they do not live in the household. The term\n\ndoes not include persons sharing the same general house, when the\n\nliving style is primarily that of a dormitory or commune;\n\n3. “Severe” or “extraordinary” means serious, extreme, or life-\n\nthreatening including temporary disability resulting from pregnancy,\n\nmiscarriage, childbirth, and recovery therefrom; and\n\n4. “District employee” means a teacher or any full-time\n\nemployee of the school district.\n\nC. A district employee may be eligible to receive shared leave\n\npursuant to the following conditions:\n\n1. The board of education determines that the employee meets\n\nthe criteria described in this section; and\n\n2. The employee has abided by district policies regarding the\n\nuse of sick leave.\n\nD. A district employee may donate annual leave to another\n\ndistrict employee only pursuant to the following conditions:\n\n1. The receiving employee has exhausted, or will exhaust,\n\nmaternity leave granted pursuant to Section 1 of this act or sick\n\nleave earned pursuant to Section 6-104 of this title due to\n\npregnancy, miscarriage, childbirth and recovery therefrom, an\n\nillness, injury, impairment, or physical or mental condition, which\n\nis of an extraordinary or severe nature, and involves the employee,\n\na relative of the employee, or household member;\n\n2. The condition has caused, or is likely to cause, the\n\nemployee to go on leave without pay or to terminate employment;\n\n3. The board of education of the district permits the leave to\n\nbe shared with an eligible employee;\n\n4. The amount of leave to be donated is within the limits set\n\nby the board of education of the district; and\n\n5. District employees may not donate excess sick leave that the\n\ndonor would not be able to otherwise take.\n\nE. The board of education of each school district shall\n\ndetermine the amount of donated leave an employee may receive.\n\nF. The board of education shall require the employee to submit,\n\nprior to approval or disapproval, a medical certificate from a\n\nlicensed physician or health care practitioner verifying the severe\n\nor extraordinary nature and expected duration of the condition.\n\nG. Donated sick leave is transferable between employees of\n\ndifferent school districts in the state with the agreement of both\n\nboards of education of each school district.\n\nH. The receiving employee shall be paid the regular rate of pay\n\nof the employee. The sick leave received will be designated as\n\nshared sick leave and be maintained separately from all other sick\n\nleave balances.\n\nI. Any donated sick leave may only be used by the recipient for\n\nthe purposes specified in this section.\n\nJ. Maternity leave granted pursuant to Section 1 of this act\n\nand sick leave earned pursuant to Section 6-104 of this title\n\navailable for use by the recipient shall be used prior to using\n\nshared sick leave.\n\nK. Any shared sick leave not used by the recipient during each\n\noccurrence as determined by the board of education shall be returned\nsection.\n\nJ. Maternity leave granted pursuant to Section 1 of this act\n\nand sick leave earned pursuant to Section 6-104 of this title\n\navailable for use by the recipient shall be used prior to using\n\nshared sick leave.\n\nK. Any shared sick leave not used by the recipient during each\n\noccurrence as determined by the board of education shall be returned\n\nto the donor. The shared sick leave remaining will be divided among\n\nthe donors on a prorated basis based on the original donated value\n\nand returned at its original donor value and reinstated to the\n\nannual leave balance of each donor.\n\nL. All donated sick leave shall be given voluntarily. No\n\nemployee shall be coerced, threatened, intimidated, or financially\n\ninduced into donating sick leave for purposes of the leave sharing\n\nprogram.\n\nM. In addition to the sick leave sharing program provided for\n\nin this section, the board of education of each school district may\n\nestablish a sick leave sharing bank for all district employees. A\n\ndistrict employee may donate sick leave to a common fund which may\n\nbe used by any district employee who is eligible to receive shared\n\nleave as set forth in subsection A of this section. The terms and\n\nconditions for donation and use of sick leave to a leave sharing\n\nbank shall be subject to the provisions of this section, unless\n\nnegotiations, entered into pursuant to Section 509.1 et seq. of this\n\ntitle, between district employees and the school district establish\n\nterms and conditions for a sick leave sharing bank in excess of\n\nthose provided for in this section.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"202dd022580353125326272a802914f7ad643ce18a46c5d3ab2fc2cf729d3c8e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-6-104.5","next":"us-ok/okla.-stat.-tit.-70-70-6-104.7"},"notice":"GroundRules: Original legal text.
