Stat. tit. 70, § 70-6-105","heading":"Payment - Duration of employment - Leave of absence for","body":"military service - Contracts for training and employment of\n\nsubstitutes.\n\nA. If, because of sickness or other reason, a teacher is\n\ntemporarily unable to perform regular duties, a substitute teacher\n\nmay be employed for the position for the time of the absence. A\n\nsubstitute teacher shall be paid in an amount and under such terms\n\nas may be agreed upon in advance by the substitute teacher and the\n\nboard of education or according to regulations of the board. If a\n\nteacher is absent for reason of personal business the school\n\ndistrict shall deduct from the salary of the teacher only the amount\n\nnecessary to pay the substitute.\n\nB. No substitute teacher shall be employed for a total period\n\nof time in excess of one hundred thirty-five (135) school days\n\nduring a school year; or one hundred forty-five (145) school days\n\nduring the school year if the substitute teacher holds a lapsed or\n\nexpired certificate or has a bachelors level college degree; or no\n\nlimit of school days during the school year if the substitute\n\nteacher holds a valid certificate. Each school district shall adopt\n\na policy which sets forth the maximum number of days a substitute\n\nteacher may be employed for the same assignment if the substitute\n\nteacher does not hold a valid certificate.\n\nC. Substitute teachers who do not hold a valid certificate and\n\nwho are employed to teach special education for students with\n\nphysical disabilities or students with intellectual disabilities\n\nshall not be subject to the restrictions on total time a substitute\n\nteacher may be employed if no certified teachers are available to\n\nteach such students and the students would be denied instruction in\n\nspecial education if the substitute teacher were not employed.\n\nBeginning with the 2007-08 school year, any substitute teacher\n\nemployed to teach special education for the same assignment for more\n\nthan fifteen (15) consecutive or thirty (30) total school days\n\nduring a school year who does not hold a valid certificate to teach\n\nspecial education shall be required to complete in-service training\n\nas prescribed by the State Board of Education. The training shall\n\nbe provided at no cost to the substitute teacher. Availability of\n\ncertified teachers shall be determined after the school has\n\nconsulted the State Board of Education and any other resources for\n\nfilling the vacant position with a certified teacher.\n\nD. A school district may request a waiver of the restrictions\n\non total time a substitute teacher may be employed from the State\n\nBoard of Education for a substitute teacher who does not hold a\n\nvalid certificate. The school district shall submit evidence on the\n\navailability of certified substitute teachers and the qualifications\n\nof the substitute teacher. The Board shall develop procedures for\n\nthe filing and processing of substitute teacher waivers pursuant to\n\nthis subsection.\n\nE. Payment of salary to a substitute shall have no effect on\n\nthe amount of salary to which the absent regular teacher is entitled\n\nunder the applicable leave plan.\n\nF. Any substitute or cadet teacher employed in any school\n\nsystem on a monthly or annual basis shall hold a certificate and\n\nhave a written contract in the manner and under the same conditions\n\nas for regular teachers.\n\nG. Teachers who are members of the Reserve Forces of the Army,\n\nthe Navy, the Marine Corps, the Coast Guard, the Air Force, or any\n\nother component of the Armed Forces of the United States, including\n\nmembers of the Air or Army National Guard, shall, when ordered by\n\nthe proper authority to active duty or service, be entitled to a\n\nleave of absence from such civil employment for the period of such\n\nactive service without loss of status or efficiency rating and\n\nwithout loss of pay during the first thirty (30) days of such leave\n\nof absence.\n\nH. School districts in this state may contract with outside\n\nproviders for the training and employment of substitute teachers.\noper authority to active duty or service, be entitled to a\n\nleave of absence from such civil employment for the period of such\n\nactive service without loss of status or efficiency rating and\n\nwithout loss of pay during the first thirty (30) days of such leave\n\nof absence.\n\nH.
