For licensees determined to be in default, pursuant to the\n\napplicable federal regulation, the Oklahoma State Regents for Higher\n\nEducation shall prescribe rules and procedures to provide an\n\nopportunity for the licensee to enter into a satisfactory repayment\n\nagreement and an opportunity for a hearing prior to notification of\n\na licensing board. At least thirty (30) days prior to notification\n\nof the appropriate licensing board, the State Regents shall mail to\n\nthe licensee's last-known address, a written notice of:\n\n1. The nature and amount of the debt;\n\n2. The intention of the State Regents to issue notification of\n\ndefault to the appropriate licensing board or boards; and\n\n3. The explanation of the licensee's rights.\n\nB. Following the determination of default, as defined by\n\nfederal law, the licensee shall be provided the opportunity of a\n\nhearing conducted by a hearing official appointed by the State\n\nRegents. The hearing official may be any qualified individual,\n\nincluding an administrative law judge, not under the direct\n\nsupervision or control of the State Regents. Upon written request\n\nby the licensee, the decision of the hearing official may be\n\nappealed to the State Regents. The State Regents may notify each\n\nlicensing board in this state of any person who has been determined\n\nto be in default on a student loan; provided, the State Regents may\n\nconsider hardship circumstances in their decision whether to proceed\n\nwith notification. Except as otherwise provided in this section,\n\nupon receipt of the notice, the licensing boards shall suspend and\n\nnot renew the license of the licensee until further notification by\n\nthe State Regents.\n\nC. Except as otherwise provided in this section, no further\n\nadministrative review or contested case proceeding within or by the\n\nlicensing board is required upon notification of the State Regent’s\n\ndetermination of default. No licensing board shall be held liable\n\nfor any suspension or nonrenewal of a license or commercial driver\n\nlicense pursuant to the provisions of this act.\n\nD. The State Regents shall notify, as soon as possible and no\n\nlater than ten (10) business days, each licensing board when a\n\nformerly reported licensee is no longer in default status due to\n\nrepayment in full, loan rehabilitation or some other action that\n\ndischarges the licensee of responsibility for repayment or when the\n\nlicensee achieves satisfactory repayment status. Except as\n\notherwise provided in this section, the issuing licensing board\n\nshall reinstate or renew the license of the licensee within thirty\n\n(30) days of receiving notice from the State Regents, contingent\n\nupon the requirements of the licensing board.\n\nE. If the Oklahoma Bar Association receives notice that a\n\nlicensed attorney is in default, the Bar Association must begin\n\nproceedings by which the attorney may be suspended pursuant to Rules\n\nGoverning Disciplinary Proceedings. If suspended, the attorney may\n\nbe reinstated pursuant to reinstatement procedures as provided in\n\nthe Rules Governing Disciplinary Proceedings.\n\nF. For purposes of this act:\n\n1. “Licensing board” means any bureau, department, division,\n\nboard, agency or commission of this state or of a municipality in\n\nthis state that issues a license;\n\n2. “License” means a license, certificate, registration,\n\npermit, approval or other similar document issued by a licensing\n\nboard granting to an individual a right or privilege to engage in a\n\nprofession, occupation or business, including Class A, B or C\n\ncommercial driver licenses issued pursuant to Title 47 of the\n\nOklahoma Statutes; and\n\n3. “Licensee” means any individual who is issued a license by\n\nany licensing board in this state.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bb5fd6acc8f9caa062bbb58e0b0c7a35791adef1717e2d1cefb5a40870839e30","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-623","next":"us-ok/okla.-stat.-tit.-70-70-624"},"notice":"GroundRules: Original legal text.
