Stat. tit. 70, § 70-625.10a","heading":"Cost-sharing scholarships and loan fund programs -","body":"Administration.\n\nThe Health Care Workforce Training Commission is hereby\n\nauthorized and empowered to establish and administer cost-sharing\n\nscholarships and loan fund programs which shall provide for state\n\nassistance to and participation with community physician education\n\nand scholarship trust funds which are selected and approved by the\n\nCommission. Said state assistance and participation shall be on a\n\nstate and community matching formula basis for the funding of the\n\neducational costs, fees and charges of a selected and qualified\n\nstudent in good standing and who is duly enrolled in an accredited\n\ncollege of medicine or college of osteopathic medicine and pursuing\n\na course of study leading to the degree of Doctor of Medicine or to\n\nthe degree of Doctor of Osteopathic Medicine. Said student shall be\n\na bona fide resident of the State of Oklahoma who desires and agrees\n\nto practice his profession on completion of the course of study and\n\ntraining required for licensure and certification in the community\n\nproviding the initial funds to be matched by the state funds.\n\nCommunities shall deposit the initial trust funds with the Health\n\nCare Workforce Training Commission to be administered and matched by\n\nthe Commission for the education of selected and qualified students\n\nto serve and to practice in the communities with trust funds so\n\nestablished for that purpose with the Commission. The Commission\n\nshall aid and advise communities in the selection of qualified\n\nstudents to participate in a given community scholarship program and\n\nthe Commission shall approve the selection of a given student for a\n\nparticular community physician education scholarship trust fund\n\nmatching program. The Commission shall determine the percentage\n\nshare for the state in the scholarship matching program with a given\n\ncommunity to educate a given and duly selected student on the basis\n\nof the extent of need of the community and its surrounding area for\n\nthe services of a practicing physician, the amount of the initial\n\ntrust funds the community has raised and deposited in the physician\n\neducation scholarship trust fund that is duly established and the\n\nmatching funds schedule developed by the Commission and based upon\n\nboth the population of the community determined by the latest\n\nFederal Decennial Census and the estimated median family annual\n\nincome level as determined on the basis of the estimates of the\n\nOklahoma Department of Commerce. The state matching assistance and\n\nparticipation in a given scholarship trust fund program shall not\n\nexceed seventy-five percent (75%) of the total amount calculated to\n\nbe necessary to fund the costs of a course of study for the degree\n\nof Doctor of Medicine or the degree of Doctor of Osteopathic\n\nMedicine as determined annually by the Commission. Repayment of the\n\ntotal amount of the scholarship by the student on completion of the\n\nstudent's course of study and on the establishment of the student's\n\npractice in the community shall be made to the state fund and to the\n\ncommunity trust fund in accordance with the percentage and total\n\namounts contributed by the state and by the community to the\n\nmatching scholarship trust fund program and in accordance with the\n\nprovisions of Section 625.5 of this title and contract requirements\n\nof Section 625.6 of this title which shall apply in all cases to\n\nstudents participating in said community physician education\n\nscholarship trust fund programs administered by the Commission with\n\nthe exception of the maximum amount allowable in payment to the\n\nstudent which shall be based on an annual review of the costs, fees\n\nand charges of the school of medicine or school of osteopathic\n\nmedicine in which the student is enrolled and participating which\n\nshall be made by the Commission.\n\nThe procedures, terms and conditions governing the scholarships\n\nand how they are administered shall be as prescribed and formulated\nount allowable in payment to the\n\nstudent which shall be based on an annual review of the costs, fees\n\nand charges of the school of medicine or school of osteopathic\n\nmedicine in which the student is enrolled and participating which\n\nshall be made by the Commission.\n\nThe procedures, terms and conditions governing the scholarships\n\nand how they are administered shall be as prescribed and formulated\n\nby the Health Care Workforce Training Commission but shall include\n\nthe following:\n\n1. Communities desiring to participate in a loan and\n\nscholarship program shall select a student who meets the\n\nrequirements for participation and give notice to the Commission.\n\n2. The Commission shall aid and advise communities in the\n\nselection of qualified students to participate in a given community\n\nloan and scholarship program.\n\n3. The communities shall deposit with the Commission the\n\ninitial year scholarship funds provided by the community which funds\n\nshall be a percentage of the total educational and associated costs\n\nof the student in the course of study in an accredited college of\n\nmedicine or college of osteopathic medicine and which funds are to\n\nbe used in the education of the selected student.\n\n4. The Commission shall review and approve the selection of a\n\ngiven student and shall then match the initial community funds with\n\nstate funds from the Oklahoma Community Physician Education Loan and\n\nScholarship Program Fund in the amount needed to meet the total cost\n\nfor educating the student for one (1) year as agreed by the\n\nCommission and the community in each particular case.\n\n5. The Commission shall determine the percentage share for the\n\nstate in the loan and scholarship program with a given community to\n\neducate a selected student on the basis of:\n\na. the extent of need of the community and its\n\nsurrounding area for the services of a practicing\n\nphysician,\n\nb. the amount of the initial trust funds the community\n\nhas raised and deposited with the Commission for the\n\neducation of a selected student, and\n\nc. the population of the community which shall be\n\ndetermined on the basis of the current estimates made\n\nby the Oklahoma Department of Commerce.\n\n6. The state matching assistance and participation by the\n\nCommission in a given loan and scholarship program for a particular\n\nstudent shall not exceed seventy-five percent (75%) of the total\n\namount calculated to be necessary to fund one (1) year of study for\n\nthe degree of Doctor of Medicine or the degree of Doctor of\n\nOsteopathic Medicine as determined annually by the Commission at the\n\nschool of medicine or osteopathic medicine in which the selected\n\nstudent is enrolled.\n\n7. Each scholarship recipient, upon completion of the\n\nrecipient's course of study, shall repay the recipient's loan and\n\nscholarship to the state and to the community and receive\n\nforgiveness on repayment of the funds from the state and from the\n\ncommunity by practicing his or her profession in the community in\n\nOklahoma providing the initial funds at a minimum for one (1) year\n\nfor each Five Thousand Dollars ($5,000.00) the community and the\n\nstate financed the scholarship program for the student; provided,\n\nhowever, that the recipient will be given no credit for payment,\n\nrepayment and reduction of said obligation to the community and the\n\nstate by serving the given community for a period less than two (2)\n\nyears or, when approved by the Commission in agreement with the\n\ncommunity and terms of the contracts involved, repayment may be made\n\nin cash with interest at the rate of twelve percent (12%) per annum,\n\nsaid interest to accrue from the date each payment of funds pursuant\n\nto the loan and scholarship program is made. In addition, should a\n\nrecipient who accepts financial assistance after July 1, 1977, elect\n\nnot to perform his obligated service in the sponsoring community,\n\nthe agreed upon sum denoted as liquidated damages in the contract\nth interest at the rate of twelve percent (12%) per annum,\n\nsaid interest to accrue from the date each payment of funds pursuant\n\nto the loan and scholarship program is made. In addition, should a\n\nrecipient who accepts financial assistance after July 1, 1977, elect\n\nnot to perform his obligated service in the sponsoring community,\n\nthe agreed upon sum denoted as liquidated damages in the contract\n\nshall be assessed the recipient. No interest shall accrue on the\n\nprincipal during any one period of time that the recipient thereof\n\nis required to serve in the Armed Forces of the United States, or\n\nduring his internship or residency, if in a primary care area and\n\nthe required service, internship or residency does not exceed four\n\n(4) years. Provided that no interest shall accrue for six (6)\n\nmonths following each of the above exceptions.\n\nEach student who applies to participate in a community and state\n\nmatching loan and scholarship program shall enter into a contract\n\nadministered by the Commission on behalf of the state and a given\n\ncommunity which has provided the initial scholarship funds to\n\neducate a selected student. The contract shall be between the State\n\nof Oklahoma and the selected student by which contract the student\n\nagrees to return to the community which provided the initial loan\n\nand scholarship funds and to practice his profession, on completion\n\nof the course of study and training required for licensure and\n\ncertification, for the number of years for which the student\n\nreceived assistance from the community and the state and in\n\naccordance with the conditions specified in the contract agreed to\n\nby the student and the given community which selected the student.\n\nAny repayment of the total amount of the scholarship or any portion\n\nthereof as provided in this act and in the contract between the\n\nstate and the student shall be made to the state deposited into the\n\nCommunity Matching Loan and Scholarship Repayment Revolving Fund\n\nhereby created in the State Treasury. The community portion of any\n\nrepayment monies deposited in said fund shall be withdrawn from the\n\nrevolving fund and returned to the community on request or, if the\n\ncommunity so chooses, said repayment monies shall be held available\n\nin said fund for reallocation by the community and the state to the\n\nCommunity Physician Education Loan and Scholarship Program Fund to\n\neducate another student selected by the community and approved by\n\nthe Commission. The form of the contracts shall be prepared and\n\napproved by the Attorney General. The Commission is hereby vested\n\nwith full and complete authority and power to sue in its own name\n\nany applicant for any balance due the Commission for repayment of\n\nthe scholarship on any contract or for failure by the applicant to\n\nfulfill the terms of his contract in any way.
