In order that any student may be transferred, an application\n\nform specified by the State Board of Education must be completed by\n\nthe parents of the student. For purposes of the Education Open\n\nTransfer Act, the term “parent” means the parent of the student or\n\nperson having custody of the student as provided for in paragraph 1\n\nof subsection A of Section 1-113 of this title. The application\n\nshall be filed with the superintendent of the receiving school\n\ndistrict for transfers to school districts in this state and with\n\nthe State Board of Education for transfers to school districts in\n\nanother state.\n\nB. On or before the first day of January, April, July and\n\nOctober, it shall be the duty of the superintendent of the receiving\n\nschool district to file with the State Board of Education and each\n\nresident district a statement showing the names of the students\n\ngranted transfers to the school district, the resident school\n\ndistrict of the transferred students and their respective grade\n\nlevel.\n\nC. For students who are deaf or hearing-impaired who wish to\n\ntransfer to a school district with a specialized deaf education\n\nprogram, applications may be filed at any time during the school\n\nyear. The student may transfer to the receiving school district at\n\nany time during the school year.\n\nD. The school district shall enroll transfer students in the\n\norder in which they submit their applications. If the number of\n\nstudent transfer applications exceeds the capacity of a receiving\n\nschool district, as determined by subsection A of Section 8-101.2 of\n\nthis title, the district shall select transfer students in the order\n\nin which the district received the student transfer applications.\n\nE.
