Except as provided in subsection B of this section,\n\nbeginning July 1, 2024, the transfer of a student from one school\n\nsite to another school site within the school district where the\n\nstudent resides shall be approved at any time in the year, unless\n\nthe grade level of the receiving school site has reached capacity.\n\nIf the capacity of a grade level is insufficient to enroll all\n\neligible students, the school district shall select intra-district\n\ntransfer students based on the preferences outlined in paragraph 1\n\nof subsection B of this section and then in the order in which the\n\nintra-district transfer applications were received. The school\n\ndistrict board of education shall determine the capacity of a school\n\nsite based on its policy adopted pursuant to subsection B of this\n\nsection. A student may be granted a one-year intra-district\n\ntransfer and shall automatically continue to attend the school site\n\nwhere the student transferred each school year, unless the school\n\ndistrict denies the continued intra-district transfer for the\n\nreasons outlined in paragraphs 2 and 3 of subsection B of this\n\nsection. At the end of each school year, a school district may only\n\ndeny continued intra-district transfer of the student for the\n\nreasons outlined in paragraphs 2 and 3 of subsection B of this\n\nsection.\n\n1. Any sibling of a student who transfers intra-district may\n\nattend the school site to which the student transferred if the\n\nschool district policy gives preference to sibling transfers\n\nregardless of capacity and the sibling of the transferred student\n\ndoes not meet a basis for denial as outlined in paragraphs 2 and 3\n\nof subsection B of this section.\n\n2. The child of a school district employee who resides in the\n\nschool district but wishes to attend a different school site within\n\nthe school district where the student resides may be granted an\n\nintra-district transfer if the school district policy gives\n\npreference to the transfer of children of school district employees\n\nand the student does not meet a basis for denial as outlined in\n\nparagraphs 2 and 3 of subsection B of this section.\n\n3. A student who changes residence within a school district and\n\nwho wishes to attend the same school site may be granted an intra-\n\ndistrict transfer if the school district policy gives preference to\n\nsuch transfers and the student does not meet a basis for denial as\n\noutlined in paragraphs 2 and 3 of subsection B of this section.\n\n4. Any child in the custody of the Department of Human Services\n\nand living in foster care who resides in the home of another student\n\nwho transfers intra-district may attend the school site to which the\n\nstudent transferred.\n\nExcept for a child in the custody of the Department of Human\n\nServices in foster care, an intra-district transfer student shall\n\nnot transfer more than two times per school year to other school\n\nsites within the school district where the student resides, provided\n\nthat the student may always reenroll at any time in his or her\n\nschool site of residence.\n\nB. Each school district board of education shall adopt a policy\n\nto determine the number of intra-district transfer students the\n\nschool district has the capacity to accept in each grade level for\n\neach school site within a school district no later than July 1,\n\n2024. The policy shall be publicly posted on the school district\n\nwebsite. The policy:\n\n1. Shall include an enrollment preference and reserve capacity\n\nfor:\n\na. students who reside in the school site boundary,\n\nb. students who attended the school site the prior school\n\nyear,\n\nc. siblings of students who are already enrolled at the\n\nschool site,\n\nd. children of school district employees who wish to\n\nattend a different school site within the school\n\ndistrict, and\n\ne. students who change residence within a school district\n\nand who wish to attend the same school site;\nwho reside in the school site boundary,\n\nb. students who attended the school site the prior school\n\nyear,\n\nc. siblings of students who are already enrolled at the\n\nschool site,\n\nd. children of school district employees who wish to\n\nattend a different school site within the school\n\ndistrict, and\n\ne. students who change residence within a school district\n\nand who wish to attend the same school site;\n\n2. May include the acts and reasons outlined in Section 24-\n\n101.3 of this title as a basis for denial of an intra-district\n\ntransfer; and\n\n3. May include a history of absences as a basis for denial of\n\nan intra-district transfer. For the purposes of this section,\n\n\"history of absences\" means ten or more absences in one semester\n\nthat are not excused for the reasons provided in subsection B of\n\nSection 10-105 of this title or due to illness.\n\nC. By the first day of January, April, July, and October of\n\neach year, the school district board of education shall establish\n\nthe number of intra-district transfer students the school district\n\nhas the capacity to accept in each grade level for each school site\n\nwithin the district.\n\nD. After establishing the number of intra-district transfer\n\nstudents the school district has the capacity to accept in each\n\ngrade level for each school site, the board of education shall:\n\n1. Publish in a prominent place on the school district website\n\nthe number of intra-district transfer students for each grade level\n\nfor each school site within the school district which the district\n\nhas the capacity to accept; and\n\n2. Report to the State Department of Education the number of\n\nintra-district transfer students for each grade level for each\n\nschool site within the school district which the district has the\n\ncapacity to accept.\n\nE. 1. Notwithstanding the provisions of this section, school\n\ndistricts shall allow students who are the dependent children of a\n\nmember of the active uniformed military services of the United\n\nStates on full-time active duty status, and students who are the\n\ndependent children of a member of the military reserve on active\n\nduty orders, provisional eligibility for intra-district transfers\n\nregardless of capacity. The number of intra-district transfers\n\nspecific to military dependents shall be based on two (2) military\n\ndependents per one hundred (100) enrolled students at the elementary\n\nschool level, four (4) military dependents per one hundred (100)\n\nstudents at the middle school level, and six (6) military dependents\n\nat the high school level. Students shall be eligible under this\n\nsubsection as outlined in paragraphs 1 and 2 of subsection B of\n\nSection 8-103.1 of this title.\n\n2.
