An educational institution or student athlete may bring an\n\naction for damages against an athlete agent if the institution or\n\nathlete is adversely affected by an act or omission of the agent in\n\nviolation of the Revised Uniform Athlete Agents Act. An educational\n\ninstitution or student athlete is adversely affected by an act or\n\nomission of the agent only if, because of the act or omission, the\n\ninstitution or an individual who was a student athlete at the time\n\nof the act or omission and enrolled in the institution:\n\n1. Is suspended or disqualified from participation in an\n\ninterscholastic or intercollegiate sports event by or under the\n\nrules of a state or national federation or association that promotes\n\nor regulates interscholastic or intercollegiate sports; or\n\n2. Suffers financial damage.\n\nB. A plaintiff that prevails in an action under this section\n\nmay recover actual damages, exemplary damages, costs and reasonable\n\nattorney fees. An athlete agent found liable under this section\n\nforfeits any right of payment for anything of benefit or value\n\nprovided to the student athlete and shall refund any consideration\n\npaid to the agent by or on behalf of the athlete.\n\nC.
