As used in the Revised Uniform Athlete Agents Act:\n\n1. \"Agency contract\" means an agreement in which a student\n\nathlete authorizes a person to negotiate or solicit on behalf of the\n\nathlete a professional-sports-services contract or endorsement\n\ncontract;\n\n2. \"Athlete agent\":\n\na. means an individual, whether or not registered under\n\nthe Revised Uniform Athlete Agents Act, who:\n\n(1) directly or indirectly recruits or solicits a\n\nstudent athlete to enter into an agency contract\n\nor, for compensation, procures employment or\n\noffers, promises, attempts or negotiates to\n\nobtain employment for a student athlete as a\n\nprofessional athlete or member of a professional\n\nsports team or organization,\n\n(2) for compensation or in anticipation of\n\ncompensation related to a student athlete's\n\nparticipation in athletics:\n\n(a) serves the athlete in an advisory capacity\n\non a matter related to finances, business\n\npursuits or career management decisions,\n\nunless the individual is an employee of an\n\neducational institution acting exclusively\n\nas an employee of the institution for the\n\nbenefit of the institution, or\n\n(b) manages the business affairs of the athlete\n\nby providing assistance with bills,\n\npayments, contracts, or taxes, or\n\n(3) in anticipation of representing a student athlete\n\nfor a purpose related to the athlete's\n\nparticipation in athletics:\n\n(a) gives consideration to the student athlete\n\nor another person,\n\n(b) serves the athlete in an advisory capacity\n\non a matter related to finances, business\n\npursuits or career management decisions, or\n\n(c) manages the business affairs of the athlete\n\nby providing assistance with bills,\n\npayments, contracts or taxes, but\n\nb. does not include an individual who:\n\n(1) acts solely on behalf of a professional sports\n\nteam or organization, or\n\n(2) is a licensed, registered or certified\n\nprofessional and offers or provides services to a\n\nstudent athlete customarily provided by members\n\nof the profession, unless the individual:\n\n(a) also recruits or solicits the athlete to\n\nenter into an agency contract,\n\n(b) also, for compensation, procures employment\n\nor offers, promises, attempts or negotiates\n\nto obtain employment for the athlete as a\n\nprofessional athlete or member of a\n\nprofessional sports team or organization, or\n\n(c) receives consideration for providing the\n\nservices calculated using a different method\n\nthan for an individual who is not a student\n\nathlete;\n\n3. \"Athletic director\" means the individual responsible for\n\nadministering the overall athletic program of an educational\n\ninstitution or, if an educational institution has separately\n\nadministered athletic programs for male students and female\n\nstudents, the athletic program for males or the athletic program for\n\nfemales, as appropriate;\n\n4. \"Educational institution\" includes a public or private\n\nelementary school, secondary school, technical or vocational school,\n\ncommunity college, college or university;\n\n5. \"Endorsement contract\" means an agreement under which a\n\nstudent athlete is employed or receives consideration to use on\n\nbehalf of the other party any value that the athlete may have\n\nbecause of publicity, reputation, following or fame obtained because\n\nof athletic ability or performance;\n\n6. \"Enrolled\" means registered for courses and attending\n\nathletic practice or class. \"Enrolls\" has a corresponding meaning;\n\n7. \"Intercollegiate sport\" means a sport played at the\n\ncollegiate level for which eligibility requirements for\n\nparticipation by a student athlete are established by a national\n\nassociation that promotes or regulates collegiate athletics;\n\n8. \"Interscholastic sport\" means a sport played between\n\neducational institutions that are not community colleges, colleges\n\nor universities;\n\n9. \"Licensed, registered or certified professional\" means an\n\nindividual licensed, registered or certified as an attorney, dealer\nparticipation by a student athlete are established by a national\n\nassociation that promotes or regulates collegiate athletics;\n\n8. \"Interscholastic sport\" means a sport played between\n\neducational institutions that are not community colleges, colleges\n\nor universities;\n\n9. \"Licensed, registered or certified professional\" means an\n\nindividual licensed, registered or certified as an attorney, dealer\n\nin securities, financial planner, insurance agent, real estate\n\nbroker or sales agent, tax consultant, accountant, or member of a\n\nprofession other than that of athlete agent who is licensed,\n\nregistered or certified by the state or a nationally recognized\n\norganization that licenses, registers or certifies members of the\n\nprofession on the basis of experience, education or testing;\n\n10. \"Person\" means an individual, estate, business or nonprofit\n\nentity, public corporation, government or governmental subdivision,\n\nagency, or instrumentality or other legal entity;\n\n11. \"Professional-sports-services contract\" means an agreement\n\nunder which an individual is employed as a professional athlete or\n\nagrees to render services as a player on a professional sports team\n\nor with a professional sports organization;\n\n12. \"Record\" means information that is inscribed on a tangible\n\nmedium or that is stored in an electronic or other medium and is\n\nretrievable in perceivable form;\n\n13. \"Recruit or solicit\" means attempt to influence the choice\n\nof an athlete agent by a student athlete or, if the athlete is a\n\nminor, a parent or guardian of the athlete. The term does not\n\ninclude giving advice on the selection of a particular agent in a\n\nfamily, coaching or social situation unless the individual giving\n\nthe advice does so because of the receipt or anticipated receipt of\n\nan economic benefit, directly or indirectly, from the agent;\n\n14. \"Registration\" means registration as an athlete agent under\n\nthe Revised Uniform Athlete Agents Act;\n\n15. \"Sign\" means, with present intent to authenticate or adopt\n\na record:\n\na. to execute or adopt a tangible symbol, or\n\nb. to attach to or logically associate with the record an\n\nelectronic symbol, sound or process;\n\n16. \"State\" means a state of the United States, the District of\n\nColumbia, Puerto Rico, the United States Virgin Islands, or any\n\nterritory or insular possession subject to the jurisdiction of the\n\nUnited States; and\n\n17. \"Student athlete\" means an individual who is eligible to\n\nattend an educational institution and engages in, is eligible to\n\nengage in, or may be eligible in the future to engage in any\n\ninterscholastic or intercollegiate sport.
