A student athlete may earn payments for the use of the name,\n\nimage, or likeness of the student athlete or as otherwise permitted\n\nby a collegiate athletic association with authority over his or her\n\npostsecondary institution without penalty or resulting limitation on\n\nparticipation. Such payments shall not affect the student athlete’s\n\neligibility for athletic grant-in-aid.\n\nB. A postsecondary institution or a third party authorized to\n\nact on behalf of the postsecondary institution may:\n\n1. Provide professional representation and pay or cause payment\n\nto be directed to a current or prospective student athlete as\n\npermitted by the Student Athlete Name, Image and Likeness Rights\n\nAct; provided, however, no postsecondary institution shall use funds\n\nallocated by this state for such payment; and\n\n2. Enter into exclusive or non-exclusive licenses or\n\nendorsement agreements for a student athlete’s name, image, or\n\nlikeness, institutional promotion, or other rights.\n\nC. A collegiate athletic association shall not prohibit a\n\npostsecondary institution or a third party authorized to act on\n\nbehalf of a postsecondary institution from identifying,\n\nfacilitating, enabling, or supporting opportunities for a student\n\nathlete to earn payment for the student athlete’s name, image, or\n\nlikeness activities.\n\nD. The provisions of this section shall not be construed to\n\nqualify a student athlete as an employee of a postsecondary\n\ninstitution or a collegiate athletic association based on the\n\nstudent athlete’s receipt of any payment or benefit permitted by\n\nthis Act or one or more of the following:\n\n1. Participation in intercollegiate athletic competition;\n\n2. Membership on any intercollegiate athletic team; or\n\n3. Imposition of requirements, controls, or restrictions on\n\nstudent athletes by postsecondary institutions, in connection with\n\ntheir participation in intercollegiate athletic activities,\n\npractices, and competition.\n\nE. No release of or license to use a student athlete’s name,\n\nimage, or likeness rights, or a name, image, or likeness agreement,\n\nshall be required from or with any individual or group of\n\nparticipants in an intercollegiate athletic competition, contest, or\n\nevent, or spectators at a sports game, contest, or event, for audio-\n\nvisual, audio, or visual broadcasts, rebroadcasts, or other\n\ndistributions of such event.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b00db51bd1455795a4a818be51d75aefbbc712b8d2b5a4ab41cd0182f0afba87","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-820.22","next":"us-ok/okla.-stat.-tit.-70-70-820.24"},"notice":"GroundRules: Original legal text.
