A collegiate athletic association shall not and shall not\n\nauthorize its member institutions to:\n\n1. Prevent a student athlete at a postsecondary institution\n\nfrom earning compensation for the use of his or her name, image, or\n\nlikeness;\n\n2. Penalize a student athlete or prevent a student athlete from\n\nfull participation in an intercollegiate sport because he or she\n\nobtains professional representation or receives assistance with\n\nservices associated with name, image, or likeness activities\n\nincluding with contracts or other legal matters from an individual,\n\nentity, or a postsecondary institution; or\n\n3. Allow compensation earned by a student athlete for the use\n\nof his or her name, image, or likeness or athletic reputation to\n\naffect the amount, duration, or renewal of or eligibility for any\n\nathletic grant-in-aid or other institutional scholarship; provided,\n\nhowever, compensation earned by a student athlete for the use of his\n\nor her name, image, or likeness or athletic reputation may be used\n\nfor the calculation of income for determining eligibility for need-\n\nbased financial aid.\n\nB. A collegiate athletic association shall not and shall not\n\nauthorize its member institutions to:\n\n1. Prevent a postsecondary institution from participation in\n\nintercollegiate athletics because a student athlete in attendance\n\nhas previously earned or intends to earn compensation for the use of\n\nhis or her name, image, or likeness;\n\n2. Entertain a complaint, open an investigation, or take any\n\nother adverse action against a postsecondary institution or an\n\nemployee or student athlete of a postsecondary institution for\n\nengaging in any activity protected in the Student Athlete Name,\n\nImage and Likeness Rights Act or for involvement in student athlete\n\nname, image, or likeness activities; or\n\n3. Penalize a postsecondary institution or an employee or\n\nstudent athlete of a postsecondary institution because an individual\n\nor entity whose purpose includes supporting or benefitting the\n\npostsecondary institution or its athletic programs violates the\n\ncollegiate athletic association’s rules or regulations with regard\n\nto student athlete name, image, or likeness activities.\n\nC.
