Stat. tit. 70, § 70-820.5","heading":"Registration as athlete agent – Application –","body":"Requirements - Reciprocal registration.\n\nREGISTRATION AS ATHLETE AGENT; APPLICATION; REQUIREMENTS;\n\nRECIPROCAL REGISTRATION.\n\nA. An applicant for registration as an athlete agent shall\n\nsubmit an application for registration to the Secretary of State in\n\na form prescribed by the Secretary of State. The applicant must be\n\nan individual, and the application must be signed by the applicant\n\nunder penalty of perjury. The application must contain at least the\n\nfollowing:\n\n1. The name and date and place of birth of the applicant and\n\nthe following contact information for the applicant:\n\na. the address of the applicant's principal place of\n\nbusiness,\n\nb. work and mobile telephone numbers, and\n\nc. any means of communicating electronically including a\n\nfacsimile number, electronic-mail address, and\n\npersonal and business or employer websites;\n\n2. The name of the applicant's business or employer, if\n\napplicable including for each business or employer its mailing\n\naddress, telephone number, organization form and the nature of the\n\nbusiness;\n\n3. Each social-media account with which the applicant or the\n\napplicant's business or employer is affiliated;\n\n4. Each business or occupation in which the applicant engaged\n\nwithin five (5) years before the date of the application including\n\nself-employment and employment by others, and any professional or\n\noccupational license, registration or certification held by the\n\napplicant during that time;\n\n5. A description of the applicant's:\n\na. formal training as an athlete agent,\n\nb. practical experience as an athlete agent, and\n\nc. educational background relating to the applicant's\n\nactivities as an athlete agent;\n\n6. The name of each student athlete for whom the applicant\n\nacted as an athlete agent within five (5) years before the date of\n\nthe application or, if the individual is a minor, the name of the\n\nparent or guardian of the minor, together with the athlete's sport\n\nand last-known team;\n\n7. The name and address of each person that:\n\na. is a partner, member, officer, manager, associate or\n\nprofit sharer or directly or indirectly holds an\n\nequity interest of five percent (5%) or greater of the\n\nathlete agent's business if it is not a corporation,\n\nand\n\nb. is an officer or director of a corporation employing\n\nthe athlete agent or a shareholder having an interest\n\nof five percent (5%) or greater in the corporation;\n\n8. A description of the status of any application by the\n\napplicant or any person named under paragraph 7 of this subsection\n\nfor a state or federal business, professional or occupational\n\nlicense, other than as an athlete agent, from a state or federal\n\nagency including any denial, refusal to renew, suspension,\n\nwithdrawal or termination of the license and any reprimand or\n\ncensure related to the license;\n\n9. Whether the applicant or any person named under paragraph 7\n\nof this subsection has pleaded guilty or no contest to, has been\n\nconvicted of, or has charges pending for, a crime that would involve\n\nmoral turpitude or be a felony if committed in this state and, if\n\nso, identification of:\n\na. the crime,\n\nb. the law enforcement agency involved, and\n\nc. if applicable, the date of the conviction and the fine\n\nor penalty imposed;\n\n10. Whether, within fifteen (15) years before the date of\n\napplication, the applicant or any person named under paragraph 7 of\n\nthis subsection has been a defendant or respondent in a civil\n\nproceeding including a proceeding seeking a judicial determination\n\nof incapacity pursuant to Sections 3-101 through 3-115 of Title 30\n\nof the Oklahoma Statutes and, if so, the date and a full explanation\n\nof each proceeding;\n\n11. Whether the applicant or any person named under paragraph 7\n\nof this subsection has an unsatisfied judgment or a judgment of\n\ncontinuing effect including alimony or a domestic order in the\n\nnature of child support, which is not current at the date of the\n\napplication;\nons 3-101 through 3-115 of Title 30\n\nof the Oklahoma Statutes and, if so, the date and a full explanation\n\nof each proceeding;\n\n11. Whether the applicant or any person named under paragraph 7\n\nof this subsection has an unsatisfied judgment or a judgment of\n\ncontinuing effect including alimony or a domestic order in the\n\nnature of child support, which is not current at the date of the\n\napplication;\n\n12. Whether, within ten (10) years before the date of\n\napplication, the applicant or any person named under paragraph 7 of\n\nthis subsection was adjudicated bankrupt or was an owner of a\n\nbusiness that was adjudicated bankrupt;\n\n13. Whether there has been any administrative or judicial\n\ndetermination that the applicant or any person named under paragraph\n\n7 of this subsection made a false, misleading, deceptive or\n\nfraudulent representation;\n\n14. Each instance in which conduct of the applicant or any\n\nperson named under paragraph 7 of this subsection resulted in the\n\nimposition of a sanction, suspension or declaration of ineligibility\n\nto participate in an interscholastic, intercollegiate or\n\nprofessional athletic event on a student athlete or a sanction on an\n\neducational institution;\n\n15. Each sanction, suspension or disciplinary action taken\n\nagainst the applicant or any person named under paragraph 7 of this\n\nsubsection arising out of occupational or professional conduct;\n\n16. Whether there has been a denial of an application for,\n\nsuspension or revocation of, refusal to renew, or abandonment of,\n\nthe registration of the applicant or any person named under\n\nparagraph 7 of this subsection as an athlete agent in any state;\n\n17. Each state in which the applicant currently is registered\n\nas an athlete agent or has applied to be registered as an athlete\n\nagent;\n\n18. If the applicant is certified or registered by a\n\nprofessional league or players association:\n\na. the name of the league or association,\n\nb. the date of certification or registration, and the\n\ndate of expiration of the certification or\n\nregistration, if any, and\n\nc. if applicable, the date of any denial of an\n\napplication for, suspension or revocation of, refusal\n\nto renew, withdrawal of, or termination of, the\n\ncertification or registration or any reprimand or\n\ncensure related to the certification or registration;\n\nand\n\n19. Any additional information required by the Secretary of\n\nState.\n\nB. Instead of proceeding under subsection A of this section, an\n\nindividual registered as an athlete agent in another state may apply\n\nfor registration as an athlete agent in this state by submitting to\n\nthe Secretary of State:\n\n1. A copy of the application for registration in the other\n\nstate;\n\n2. A statement that identifies any material change in the\n\ninformation on the application or verifies there is no material\n\nchange in the information, signed under penalty of perjury; and\n\n3. A copy of the certificate of registration from the other\n\nstate.\n\nC. The Secretary of State shall issue a certificate of\n\nregistration to an individual who applies for registration under\n\nsubsection B of this section if the Secretary of State determines:\n\n1. The application and registration requirements of the other\n\nstate are substantially similar to or more restrictive than the\n\nRevised Uniform Athlete Agents Act; and\n\n2. The registration has not been revoked or suspended and no\n\naction involving the individual's conduct as an athlete agent is\n\npending against the individual or the individual's registration in\n\nany state.\n\nD. For purposes of implementing subsection C of this section,\n\nthe Secretary of State shall:\n\n1. Cooperate with national organizations concerned with athlete\n\nagent issues and agencies in other states which register athlete\n\nagents to develop a common registration form and determine which\n\nstates have laws that are substantially similar to or more\nl or the individual's registration in\n\nany state.\n\nD. For purposes of implementing subsection C of this section,\n\nthe Secretary of State shall:\n\n1. Cooperate with national organizations concerned with athlete\n\nagent issues and agencies in other states which register athlete\n\nagents to develop a common registration form and determine which\n\nstates have laws that are substantially similar to or more\n\nrestrictive than the Revised Uniform Athlete Agents Act; and\n\n2.
