Except as provided for in subsection C of this section, no\n\nperson shall give, offer, promise or attempt to give any money or\n\nother thing of value to a student athlete or member of the immediate\n\nfamily of a student athlete:\n\n1. To induce, encourage or reward the application, enrollment\n\nor attendance of the student athlete at a public or private\n\ninstitution of postsecondary education in order to have the student\n\nathlete participate in intercollegiate sporting events, contests,\n\nexhibitions or programs at that institution; or\n\n2. To induce, encourage or reward the participation in an\n\nintercollegiate sporting event, contest, exhibition or program by\n\nthe student athlete.\n\nB. No person shall enter into or solicit directly or through an\n\nagent a transaction with a student athlete if the person has, or\n\ncould be reasonably expected to have, knowledge that the transaction\n\nwould likely cause the student athlete to permanently or temporarily\n\nlose athletic scholarship eligibility, the ability to participate on\n\nan intercollegiate athletic team or the ability to participate in\n\none or more intercollegiate sporting competitions as sanctioned by:\n\n1. A collegiate athletic association as defined in the Student\n\nAthlete Name, Image and Likeness Act;\n\n2. Any other sanctioning body; or\n\n3. The institution of postsecondary education itself as a\n\nreasonable self-imposed disciplinary action taken by the institution\n\nto mitigate sanctions likely to be imposed by an organization as a\n\nresult of the transaction or as a violation of the rules of the\n\ninstitution.\n\nC. This section shall not apply to:\n\n1. Any public or private institution of postsecondary education\n\nor to any officer or employee of the institution when the\n\ninstitution or the officer or employee of the institution is acting\n\nin accordance with an official written policy of the postsecondary\n\ninstitution;\n\n2. Any intercollegiate athletic award approved or administered\n\nby the public or private institution of postsecondary education;\n\n3. Grants-in-aid or other full or partial scholarships awarded\n\nto a student athlete or administered by a public or private\n\ninstitution of postsecondary education;\n\n4. Members of the immediate family of the student athlete;\n\n5. Money or things of value given by a person to a student\n\nathlete or the immediate family of a student athlete that do not\n\nexceed One Hundred Dollars ($100.00) in value in the aggregate on an\n\nannual basis; and\n\n6. A gift, offer, promise, or attempt to give money or other\n\nthing of value given by a person to a student athlete or member of\n\nthe immediate family of a student athlete if such gift, offer,\n\npromise, or attempt conforms with the rules of any collegiate\n\nathletic association of which the postsecondary institution is a\n\nmember.\n\nD.
