Each public and private institution of postsecondary\n\neducation located in this state that participates or engages in\n\nintercollegiate athletics shall have a right of action against any\n\nperson who engages in any activity concerning student-athletes that\n\nresults in:\n\n1. The institution being penalized, disqualified, or suspended\n\nfrom participation in intercollegiate athletics by a national\n\nassociation for the promotion and regulation of intercollegiate\n\nathletics, by an athletic conference or other sanctioning body, or\n\nby reasonable self-imposed disciplinary action taken by the\n\ninstitution to mitigate sanctions likely to be imposed by the\n\norganizations as a result of the activity; or\n\n2. The student-athlete permanently or temporarily losing\n\nathletic scholarship eligibility, the ability to participate on an\n\nintercollegiate athletic team, or the ability to participate in one\n\nor more intercollegiate sporting competitions as sanctioned by a\n\nnational association for the promotion and regulation of\n\nintercollegiate athletics, by an athletic conference or other\n\nsanctioning body or by the institution itself as a reasonable self-\n\nimposed disciplinary action taken by the institution to mitigate\n\nsanctions likely to be imposed by the organizations as a result of\n\nengaging in the activity or as a violation of the rules of the\n\ninstitution.\n\nB. An institution shall be entitled to recover all damages\n\nwhich are directly related to or which flow from and are reasonably\n\nrelated to the improper activity as described in this section and to\n\nany penalties, disqualifications and suspensions. Damages shall\n\ninclude, but are not limited to, loss of scholarships, loss of\n\ntelevision revenue, loss of bowl revenue and legal and other fees\n\nassociated with the investigation of the activity and the\n\nrepresentation of the institution before the sanctioning\n\norganizations in connection with the investigation and resolution of\n\nthe activity. If the institution is the prevailing party in its\n\ncause of action, it shall be entitled to an award of court costs,\n\ncosts of litigation and reasonable attorney fees. The institution\n\nmay request and the court may enter an injunction prohibiting any\n\nperson found liable from having any further contact with the\n\ninstitution, its student-athletes and student-athletes who have\n\nexpressed or might express an interest in attending the institution.\n\nThe institution may also request and the court may enter an\n\ninjunction prohibiting any person found liable from attending\n\nathletic contests, exhibitions, games or other events in which one\n\nor more student-athletes are participating.\n\nC.
