Stat. tit. 70, § 70-9-109","heading":"Price list and description of transportation equipment","body":"The State Board of Education is hereby authorized to request a\n\nprice list and a complete description and specifications of any\n\ntransportation equipment to be offered for sale to any school board\n\nor board of education of any district in the State of Oklahoma.\n\nThe State Board of Education shall examine such equipment to\n\ndetermine whether or not such equipment meets the requirements of\n\nthe National School Bus Standards and such other specifications as\n\nthe State Board of Education may determine as necessary to provide\n\nsafe transportation for pupils to and from school and shall approve\n\nfor sale to all schools in the State of Oklahoma transportation\n\nequipment, including bus bodies and chassis, which equipment meets\n\nor exceeds the specifications provided for the National School Bus\n\nStandards and such other specifications as the State Board of\n\nEducation may deem as necessary. Any equipment fueled by\n\nalternative fuels as defined in Section 130.13 of Title 74 of the\n\nOklahoma Statutes shall also meet any federal safety standards\n\nspecified for any equipment used to provide transportation for\n\npupils to and from school. The State Board of Education may approve\n\nauxiliary transportation equipment that is not National School Bus\n\nYellow in color.\n\nThe State Board of Education shall make a list of the equipment\n\napproved by them and the maximum price at which such equipment can\n\nbe purchased. The list shall include a complete description of the\n\nequipment. Such description shall include the specification of the\n\nschool bus bodies and chassis as well as the factory list price of\n\nsuch equipment at the various factories. Such list shall be made\n\navailable to all school districts authorized to purchase\n\ntransportation equipment. Provided, at any time there shall be any\n\nchange of specifications or prices by manufacturers of chassis or\n\nbodies, there shall be filed with the State Board of Education a\n\nrevised set of specifications and prices.\n\nThe school board or board of education of any school district\n\nauthorized to furnish transportation for pupils to and from school\n\nand receiving any State Aid funds, except as provided for in this\n\nsection, shall be required to purchase all their transportation\n\nequipment from the list so provided on sealed bids and at a price\n\nnot greater than the price filed with the State Board of Education;\n\nand the State Board of Education shall be required to deduct from\n\nany State Aid for which the school district may qualify the amount\n\npaid by any school district for transportation equipment not\n\napproved by the State Board of Education or the amount paid greater\n\nthan shown on the price list for that transportation equipment filed\n\nwith the State Board of Education. Unless otherwise exempted by\n\nthis section, all purchases made under the provisions of this act\n\nfor transportation shall be made upon sealed bids, and contract of\n\npurchase shall be awarded to the lowest and best bidder.\n\nProvided, however, any purchase or sale of used transportation\n\nequipment shall not be subject to the list and sealed bid\n\nrequirements as provided for in this section.\n\nThe State Board of Education shall adopt rules necessary for the\n\nadministration of this section and shall require from school\n\ndistrict boards of education such information and reports as\n\nnecessary for proper administration of this section.\n\nAny cost of administration of this section shall be paid by the\n\nState Board of Education from funds appropriated for the\n\nadministration of the State Aid Law.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"69e4f512d08124316e82d9a249fb13a42a04a5f49c028d8454699b3ef314ba3c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-9-108","next":"us-ok/okla.-stat.-tit.-70-70-9-110"},"notice":"GroundRules: Original legal text.
