Conduct public or private investigations within or outside\n\nof this state which the Administrator considers necessary or\n\nappropriate to determine whether a person has violated, is\n\nviolating, or is about to violate this act or a rule adopted or\n\norder issued under this act, or to aid in the enforcement of this\n\nact or in the adoption of rules and forms under this act;\n\n2. Require or permit a person to testify, file a statement, or\n\nproduce a record, under oath or otherwise as the Administrator\n\ndetermines, as to all the facts and circumstances concerning a\n\nmatter to be investigated or about which an action or proceeding is\n\nto be instituted; and\n\n3. Publish a record concerning an action, proceeding, or an\n\ninvestigation under, or a violation of, this act or a rule adopted\n\nor order issued under this act if the Administrator determines it is\n\nnecessary or appropriate in the public interest and for the\n\nprotection of investors.\n\nB. For the purpose of an investigation or proceeding under this\n\nact, the Administrator or its designated officer may administer\n\noaths and affirmations, subpoena witnesses, seek compulsion of\n\nattendance, take evidence, require the filing of statements, and\n\nrequire the production of any records that the Administrator\n\nconsiders relevant or material to the investigation or proceeding.\n\nC. If a person does not appear or refuses to testify, file a\n\nstatement, produce records, or otherwise does not obey a subpoena as\n\nrequired by the Administrator under this act, the Administrator may\n\napply to the district court of Oklahoma County or the district court\n\nin any other county where service can be obtained or a court of\n\nanother state to enforce compliance. The court may:\n\n1. Hold the person in contempt;\n\n2. Order the person to appear before the Administrator or an\n\nofficer designated by the Administrator;\n\n3. Order the person to testify about the matter under\n\ninvestigation or in question;\n\n4. Order the production of records;\n\n5. Grant injunctive relief, including restricting or\n\nprohibiting the offer or sale of securities or the providing of\n\ninvestment advice;\n\n6. Impose a civil penalty up to a maximum of Five Thousand\n\nDollars ($5,000.00) for a single violation or Two Hundred Fifty\n\nThousand Dollars ($250,000.00) for multiple violations in a single\n\nproceeding or a series of related proceedings; and\n\n7. Grant any other necessary or appropriate relief.\n\nD. This section does not preclude a person from applying to the\n\ndistrict court of Oklahoma County or a court of another state for\n\nrelief from a request to appear, testify, file a statement, produce\n\nrecords, or obey a subpoena.\n\nE. An individual is not excused from attending, testifying,\n\nfiling a statement, producing a record or other evidence, or obeying\n\na subpoena of the Administrator or a designated officer under this\n\nact or in an action or proceeding instituted by the Administrator\n\nunder this act on the ground that the required testimony, statement,\n\nrecord, or other evidence, directly or indirectly, may tend to\n\nincriminate the individual or subject the individual to a criminal\n\nfine, penalty, or forfeiture. If the individual refuses to testify,\n\nfile a statement, or produce a record or other evidence on the basis\n\nof the individual's privilege against self-incrimination, the\n\nAdministrator may apply to the district court of Oklahoma County to\n\ncompel the testimony, the filing of the statement, the production of\n\nthe record, or the giving of other evidence. The testimony, record,\n\nor other evidence compelled under such an order may not be used,\n\ndirectly or indirectly, against the individual in a criminal case,\n\nexcept in a prosecution for perjury or contempt or otherwise failing\n\nto comply with the order.\n\nF. At the request of a law enforcement or another governmental\nof the statement, the production of\n\nthe record, or the giving of other evidence. The testimony, record,\n\nor other evidence compelled under such an order may not be used,\n\ndirectly or indirectly, against the individual in a criminal case,\n\nexcept in a prosecution for perjury or contempt or otherwise failing\n\nto comply with the order.\n\nF. At the request of a law enforcement or another governmental\n\nor regulatory agency or a self-regulatory organization, the\n\nAdministrator may provide assistance if the requesting entity states\n\nthat it is conducting an investigation to determine whether a person\n\nhas violated, is violating, or is about to violate a law or rule of\n\nthe other state or foreign jurisdiction relating to securities\n\nmatters that the requesting entity administers or enforces. The\n\nAdministrator may provide the assistance by using the authority to\n\ninvestigate and the powers conferred by this section as the\n\nAdministrator determines is necessary or appropriate. The\n\nassistance may be provided without regard to whether the conduct\n\ndescribed in the request would also constitute a violation of this\n\nact or other law of this state if occurring in this state. In\n\ndeciding whether to provide the assistance, the Administrator may\n\nconsider whether the requesting entity is permitted and has agreed\n\nto provide assistance reciprocally within its state, federal or\n\nforeign jurisdiction to the Administrator on securities matters when\n\nrequested; whether compliance with the request would violate or\n\nprejudice the public policy of this state; and the availability of\n\nresources and employees of the Administrator to carry out the\n\nrequest for assistance.","path":["OK Code","Title 71"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os71.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b2152128a28c8b5967ad556e8e84dd70866c232aca395e539c610893898933b8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-71-71-1-601","next":"us-ok/okla.-stat.-tit.-71-71-1-603"},"notice":"GroundRules: Original legal text.
