If the Administrator believes that a person has engaged, is\n\nengaging, or is about to engage in an act, practice, or course of\n\nbusiness constituting a violation of this act or a rule adopted or\n\norder issued under this act or constituting a dishonest or unethical\n\npractice or that a person has, is, or is about to engage in an act,\n\npractice, or course of business that materially aids a violation of\n\nthis act or a rule adopted or order issued under this act or a\n\ndishonest or unethical practice, the Administrator may, prior to,\n\nconcurrently with, or subsequent to an administrative proceeding,\n\nmaintain an action in the district court of Oklahoma County or the\n\ndistrict court of any other county where service can be obtained to\n\nenjoin the act, practice, or course of business and to enforce\n\ncompliance with this act or a rule adopted or order issued under\n\nthis act.\n\nB. In an action under this section and on a proper showing, the\n\ncourt may:\n\n1. Issue a permanent or temporary injunction, restraining\n\norder, or declaratory judgment;\n\n2. Order other appropriate or ancillary relief, which may\n\ninclude:\n\na. an asset freeze, accounting, writ of attachment, writ\n\nof general or specific execution, and appointment of a\n\nreceiver or conservator, that may be the\n\nAdministrator, for the defendant or the defendant's\n\nassets,\n\nb. ordering the Administrator to take charge and control\n\nof a defendant's property, including investment\n\naccounts and accounts in a depository institution,\n\nrents, and profits; to collect debts; and to acquire\n\nand dispose of property,\n\nc. imposing a civil penalty up to a maximum of Five\n\nThousand Dollars ($5,000.00) for a single violation or\n\nup to Two Hundred Fifty Thousand Dollars ($250,000.00)\n\nfor more than one violation; an order of rescission,\n\nrestitution, or disgorgement directed to a person that\n\nhas engaged in an act, practice, or course of business\n\nconstituting a violation of this act or the\n\npredecessor act or a rule adopted or order issued\n\nunder this act or the predecessor act, and\n\nd. ordering the payment of prejudgment and postjudgment\n\ninterest; or\n\n3. Order such other relief as the court considers appropriate.\n\nC.
